MINUTES/GROWTH FUND AUTHORITY (JDA)

The city council of the City of Grand Forks sitting as the Growth Fund Authority met in City Hall, Room 101A, on Wednesday, July 13, 2005 at the hour of 5:00 p.m. with Vice Chairman Brooks presiding. Present at roll call were Council Members Brooks, Hamerlik, Glassheim, Kreun, Mayor Brown - 5; attending during the meeting were Council Members Christensen, Kerian - 2; absent: Council Member Gershman - 1.

APPROVE CIRRUS EXPANSION PROJECT BIDS

The staff report from urban development deputy director relating to Cirrus Expansion Project Bids, with recommendation to award withdrawal of bid submitted by Roer's Construction and award bid for general construction of the building envelope to Peterson Construction Company; reject the bid submitted by RFF Electric and award bid for preliminary electrical to Bergstrom Electric; approve bid for preliminary mechanical to Lunseth Plumbing & Heating, per the bid amounts summarized below.

Keith Lund, Urban Development, reported he had provided a revised staff report and summarized the report. He reported JDA approved the bidding of the parking lot improvements, site work and building envelope along with preliminary electrical and mechanical work, and bids were opened on Monday, July 11, and reported they received 4 bids for general construction, 1 for mechanical and 3 for electrical. Staff recommendation is to award general contract to Peterson Construction in the amount of $3,309,000 and that Roer Construction's bid of $2.8 million was low bid however this bidder failed to attend a mandatory bid conference and in addition they have sent a letter to the architects requesting their bid be withdrawn as they missed components of the bidding; a memorandum from Howard Swanson, city attorney, that if JDA chooses to reject that bid should make a specific finding that the bid contained an apparent error and authorize the bidder to withdraw his bid without further consideration and that is staff's recommendation.

He stated they received 1 bid for mechanical from Lunseth Plumbing & Heating in the amount of $31,000 and are recommending award of that bid.

He reported they received 3 bids for electrical and are recommending award to Bergstrom Electric in the amount of $42,200.00. A lower bid was received from RBB Electric, Inc. in the amount of $39,123.00 but RBB did not attend the mandatory meeting and it is staff's recommendation that bid be rejected, they did receive correspondence from RBB that states that they will not contest the rejection of their bid.

He stated that if staff recommendations are approved by the JDA the bids will come in at approx. $389,000 lower than the estimate, and recommended approval of such.

Council Member Hamerlik questioned if it is a mandatory meeting, why do they open the bids. Mr. Lund stated they should not have been opened, but were. Council Member Hamerlik stated that the bids were opened and bid was a bid, that it seems that the $2.8 million was a bid and should be done according to the specs. Council Member Glassheim stated that it seems to take that position would be putting us in a lot of trouble, bid probably not legitimate because specs. were quite clear as to requiring attendance at the pre-bid conference, that bid opened but not a legitimate bid, that opening should not have happened and treat it that way.

Council Member Christensen reported present.
Council Members Glassheim and Hamerlik moved that the JDA approved the withdrawal of bid of Roer's Construction and finds that the bid contains an error and that JDA further authorizes the bidder to withdraw the bid without further consideration. Motion carried unanimously.

Council Members Glassheim and Kreun moved that we reject the bid from RBB Electric as they did not attend the mandatory pre-bid conference. Motion carried unanimously.

Council Member Kerian reported present.

It was moved by Council Member Hamerlik and seconded by Mayor Brown to award the contract for general construction to Peterson Construction in the amount of $3,309,000, award the bid for mechanical to Lunseth Plumbing & Heating in the amount of $31,000 and to award the bid for electrical to Bergstrom Electric in the amount of $42,200. The motion carried unanimously.

It was moved by Council Member Hamerlik and seconded by Council Member Christensen that we adjourn. Motion carried.
