BOARD OF ZONING ADJUSTMENT
February 11, 2010

The Board of Zoning Adjustments held a public hearing in Room A101 of City Hall. A notice was placed in the Grand Forks Herald, as required by City Ordinances.
Chairman Kent Anderson called the meeting to order at 10:30 AM.
Members present were: Kent Anderson, Lynn Vreeland, Jim Galloway, Del Scholler, Mark Peterson, and Bob Kleve
Member absent was: None
It was moved by Lynn Vreeland and seconded by Del Scholler to dispense with the reading of the last meeting’s minutes. Motion passed unanimously.
The following appeals were heard:
1. Greg & Mary Sand, 2123 5

Ave N, have made a request for a variance to the impervious surface and second front yard setback requirements [Sections 18-0208(7)(8)(B) of the Land Development Code] in order to develop the property. Legal Description: Lots 13 & 14, Block 5, Kelsey’s 2

Addition.
Impervious surface - it was moved by Del Scholler and seconded by Lynn Vreeland to allow forty-eight percent (48%) impervious surface area coverage in order to develop the property. Motion passed unanimously.
Second front yard setback – it was moved by Lynn Vreeland and seconded by Mark Peterson to allow eight feet (8’) second front yard setback in order to develop the property. Motion passed unanimously.
2. Tony & Linda Anderson, 2097 N 42

St, have made a request for a variance to the landscaping, parking & side yard setback requirements [Sections 18-0219(9)(A), 18-0309(4)(D) & 18-0302(12)(A) of the Land Development Code] in order to build an addition onto the building. Legal Description: Lot 3 & vacated east 30’ of N 43

St, west of adjacent thereto, Block 1, Lemms Acres Subdivision.
It was moved by Jim Galloway and seconded by Del Scholler to allow only seven feet (7’) of side yard setback and reduce the landscaping requirements by the buildings and adjacent to the parking areas. Motion passed unanimously.
The parking requirements variance request is being held until the next meeting.
Jim Galloway moved for adjournment and was seconded by Mark Peterson. Motion passed unanimously.
