Grand Forks City Council Service/Safety Standby Committee

The city council of the city of Grand Forks sitting as the Service/Safety Standby Committee met in the council chambers in City Hall on Thursday, May 1, 2008 at 9:00 a.m. Present at roll call were Council Members Kreun, chair; McNamara.
Others present were Al Grasser, Chief Packett, Joe and Dawn Miranda.
Chairman Kreun called the meeting to order at 9:16 a.m. and noted that there is only one item on the agenda - an appeal process for the license application.

Matter of liquor license application for Giuseppe's Italian Ristorante.
Chairman Kreun stated the committee has appeal for the license application, that Chief Packett reviewed the application and found some inconsistencies, and asked for an explanation. Chief Packett reported he reviewed Detective Flannery's initial review of the license application, reviewed a request of March 19 to Kristi Pettit of the prosecutor's office to advise direction, but did not receive response; that Ms. Pettit reviewed correspondence from Joe and Dawn Miranda of April 24 and April 29 of this year explaining the discrepancy in the original application which centered around marking No in the category of having had a conviction, when background showed there was a conviction, and can make further comments in that regard if required.
McNamara stated that it seems to be an error, and if there was anything else that was omitted that has a bearing on this. Chief Packett stated there was nothing else, and based on his review of correspondence which seems to be reasonable explanation for the error, would recommend that the license be approved with explanation.
McNamara moved approval of the license application by Joseph Miranda dba Giuseppe's Italian Ristorante, 414 DeMers Avenue.
Kreun stated he was glad the police department went through the process and found out that there was a discrepancy which turned out to be a non-alcohol related offense and that this gives creditability to the license application process, that our system works in going through that process. He stated that if there is a problem or background information that needs to be brought forward, the system works for the appeal process also; and that when other people make applications for these licenses that it is a very serious situation and wants them to take it very seriously to fill out that application properly. He noted this matter will be placed on Monday's city council meeting for action.
Upon call for the question, the motion carried.
