PROCEEDINGS OF THE CITY COUNCIL
OF THE CITY OF GRAND FORKS, NORTH DAKOTA
February 23, 2009

The city council of the city of Grand Forks, North Dakota met in special session in the council chambers in City Hall on Monday, February 23, 2009 following the committee of the whole meeting at 5:30 o'clock p.m. with Mayor Brown presiding. Present at roll call were Council Members Bjerke, McNamara, Glassheim, Gershman, Christensen, Kreun - 6 absent: Council Member Bakken - 1.

Mayor Brown announced that anyone wishing to speak to any item may do so by being recognized prior to a vote being taken on the matter, and that the meeting is being televised.

SUSPEND AGENDA TO INCLUDE ADDITIONAL
ITEMS

It was moved by Council Member Kreun and seconded by Council Member Christensen to suspend the agenda to reconsider its February 17, 2009 action suspending the alcoholic beverage license for two days for Blues, Brews & Bar-B-Ques, Inc. dba Muddy Rivers and add to the council agenda. Carried 6 votes affirmative.

Council Member Gershman reported that the city council met with the Student Senate yesterday and they passed a Resolution of Support of Affordable Higher Education University of North Dakota Student Senate & Grand Forks City Council and asked to suspend the agenda to consider the resolution and add this to the council agenda. Council Member Kreun seconded the motion. Carried 6 votes affirmative.

APPROVE PROJECT CONCEPT REPORT FOR PROJECT
NO. 6101, PAVING PORTION OF SOUTH 48TH STREET

The staff report from the engineering department relating to Project Concept Report for Project No. 6101, paving South 48th Street from 17th Avenue South to 32nd Avenue South, with recommendation to approve the Project Concept Report, concur that the project should continue to be advanced, concur with the project concepts as proposed, select Construction Alternate B - PCCP Roadway, Storm Sewer, Street Lighting & Aggregate Shared Use Path, and agree that the Options to be included in the project should be selected as follows: Option 1, Paved Surfacing on Shared Use Path - No; Option 2, Ramp Improvements - Yes; Option 3, Open Channel Drainage - Yes; and Option 4, Box Culvert Drainage - No.

It was moved by Council Member Kreun and seconded by Council Member Bjerke that this recommendation be approved. Carried 6 votes affirmative.

TABLE LANDFILL GEOTECHNICAL EVALUATION
RESULTS, SLOPE STABILIZATION CONSTRUCTION
BIDS AND ENGINEERING SERVICES AGREEMENT

The staff report from the director of public works relating to Grand Forks Landfill Geotechnical Evaluation Results, Slope Stabilization Construction Bids and Associated Engineering Services Agreement Amendment No. 1, with recommendation to approve Grand Forks Landfill Slope Stabilization construction bid of Robinson Excavating of Grand Forks in the amount of $723,352 as the lowest and best bid and to approve the Grand Forks Landfill Slope Stabilization engineering services agreement amendment No. 1 in the amount of $177,484, Project No. 6319. The City of Grand Forks will continue to seek a resolution with the Grand Forks Regional Airport Authority and its affected interests regarding reimbursement of City of Grand Forks' expenses related to Grand Forks Landfill Slope Stabilization issue. If needed, authorize the use of Water Enterprise Fund cash funds for interim financing for the construction and engineering services. If used, the Water Enterprise Fund cash funds will be reimbursed, once a resolution is concluded regarding the Grand Forks Landfill Slope Stabilization issue.

It was moved by Council Member Gershman and seconded by Council Member Kreun to table this matter so that the public works director can work with the Airport to resolve this issue and bring it back to city council on Monday, March 2, 2009. Carried 6 votes affirmative.

RECONSIDER MATTER OF COUNCIL ACTION RE.
TO SUSPENSION OF ALCOHOLIC BEVERAGE PERMIT
FOR BLUES, BREWS & BAR-B-QUES, INC. DBA
MUDDY RIVERS

The matter of the city council's action of February 17, 2009 relating to the two-day suspension of the alcoholic beverage license for Bar-B-Ques, Inc. dba Muddy Rivers on March 13 and 14, 2009, was presented to the council

It was moved by Council Member Kreun seconded by Council Member Christensen that we reconsider this matter of council's action relating to suspension of license for Muddy Rivers. Carried 6 votes affirmative.

Council Member Gershman asked to be recused from voting on this matter, and it was so moved by Council Members Kreun and Bjerke. Carried 5 votes affirmative.

It was moved by Council Member Kreun and seconded by Council Member Christensen that we change the dates of the suspension of the alcoholic beverage license from March 13 and 14, 2009 to March 16 and March 23, 2009. Carried 5 votes affirmative, Council Member Gershman recused.

ADOPT RESOLUTION IN SUPPORT OF AFFORDABLE
HIGHER EDUCATION UNIVERSITY OF NORTH DAKOTA
STUDENT SENATE AND GRAND FORKS CITY COUNCIL

The matter of a resolution that had been adopted by the Student Senate of the University of North Dakota was presented to the city council for consideration.

Council Member Gershman introduced the Resolution in Support of Affordable Higher Education University of North Dakota Student Senate and Grand Forks City Council: Documents No. 9202 - Resolution.

It was moved by Council Member Gershman and seconded by Council Member Glassheim that this resolution be adopted. Carried 6 votes affirmative.

ADJOURN

It was moved by Council Member Kreun and seconded by Council Member Bjerke that we adjourn. Carried 6 votes affirmative.
