BOARD OF ZONING ADJUSTMENT
September 9, 2010

The Board of Zoning Adjustments held a public hearing in Room A101 of City Hall. A notice was placed in the Grand Forks Herald, as required by City Ordinances.

Chairman Kent Anderson called the meeting to order at 10:35 AM.

Members present were: Kent Anderson, Lynn Vreeland, Mark Peterson, Jim Galloway and Larry Boltz

Member absent was: Del Scholler

It was moved by Jim Galloway seconded by Mark Peterson to dispense with the reading of the last meeting’s minutes. Motion passed unanimously.

The following appeals were heard:

1. William & Kamrin Macki, 8032 32nd Ave S, have made a request for a variance to the accessory building requirements [Table 18-0206(5) of the Land Development Code] in order to build a detached garage. Legal Description: Lot D, Countryside Subdivision.

It was moved by Jim Galloway and seconded by Mark Peterson to allow only fifty feet (50’) of side yard setback in order to build a detached garage. Motion passed unanimously.

2. Hoa Rodriquez, 1734 11th Ave N, has made a request for a variance to the impervious surface area coverage and accessory building requirements [Sections 18-0209(7) & 18-0305 of the Land Development Code] in order to building a detached garage. Legal Description: Lot 12, Block 12, Westacott’s Addition.

It was moved by Jim Galloway seconded by Lynn Vreeland to allow up to fifty percent (50%) of impervious surface area coverage in order to build a detached garage and the request for zero side yard setback was denied. Motion passed unanimously.

3. Don Speare, on behalf of Lucas & Naomi Carl, 510 18th Ave S, has made a request for a variance to the impervious surface and off street parking and loading requirements [Sections 18-0208(7) & 18-0302(5)(C) of the Land Development Code] in order to pave the driveway and patio area. Legal Description: Lot 12, Block 1, Hvidston’s Subdivision.

It was moved by Lynn Vreeland seconded by Mark Peterson to allow up to fifty percent (50%) of impervious surface, allow zero side yard parking setback adjacent to garage and allow driveway setback of a minimum of thirty inches (30”). Motion passed unanimously.

Lynn Vreeland moved for adjournment and was seconded by Mark Peterson. Motion passed unanimously.
