OF THE CITY OF GRAND FORKS, NORTH DAKOTA
January 25, 2000
The city council of the city of Grand Forks, North Dakota met in special session in the council chambers in City Hall on Tuesday, January 25, 2000 at the hour of 11:45 o’clock a.m. with Mayor Owens presiding, pursuant to call by Mayor Owens which was served on all members on January 24, 2000.
Present at roll call were Council Members Brooks, Polovitz, Hamerlik, Glassheim, Carpenter, Klave, Beyer, Martinson - 9; absent: Council Members Lucke, Bouley, Lunak, Hafner - 4.
CONSIDER MATTER OF AUTHORIATION OF PROJECT
COOPERATION AGREEMENT WITH CORPS OF ENGINEERS
AND EAST GRAND FORKS
Charles Grotte, Public Works, reported that this morning council members should been delivered a copy of the final draft of the project cooperation agreement and a one page summary of the agreement. He stated that the City did request that the Corps of Engineers pursue a project for flood protection and subsequent to that there was a bill passed in Congress in October, 1998, that authorized the project and the Corps of Engineers completed their general re-evaluation report and environmental impact statement in November, 1998.

Mr. Grotte reviewed the summary of the agreement - definitions of the project, project cost, betterment, and that most of the agreement concerns financial and crediting arrangements; establishment of a project coordination team (including reps. of the US Army Corp of Engineers and both Cities); obligations of the Federal Government and obligations of the Cities. He also stated that the agreement does not include details on construction or levee alignments.
It was moved by Council Member Polovitz and seconded by Council Member Beyer that we authorize signing of the project cooperation agreement by the appropriate City officials.
Council Member Martinson expressed concern that he received this information this morning with action to be taken at this time, and that they need more advance notice.
Mr. Grotte reported that the city attorney had reviewed the agreement prior to December 15, 1999, and has received a final copy of the agreement. Council Member Beyer asked that that the motion include contingency that the city attorney review the agreement. Council Member Polovitz agreed.
Upon call for the question and upon roll call vote, the following voted “aye”: Council Members Brooks, Polovitz, Council Members Brooks, Polovitz, Hamerlik, Glassheim, Carpenter, Klave, Beyer, Babinchak, Martinson - 10; voting “nay”: none. Mayor Owens declared the motion carried.

It was moved by Council Member Bakken and seconded by Council Member Polovitz that we do now adjourn. Carried 10 votes affirmative.
