August 13, 2001
The city council of the city of Grand Forks, North Dakota met in special session in the council chambers in City Hall on Monday, August 13, 2001 at the hour of 7:00 o’clock p.m. with Mayor Brown presiding. Present at roll call were Council Members Brooks, Bjerke, Stevens, Hamerlik, Gershman, Christensen, Kerian, Bakken, Kreun, Martinson - 10; absent: Council Members Burke, Glassheim, Klave, Bakken - 4.
Mayor Brown announced that anyone wishing to speak to any item may do so by being recognized prior to a vote being taken on the matter, and that the meeting is being televised.
ADOPT ORDINANCE NO. 3897 RELATING TO WINE
AND BEER MAKERS LICENSE
An ordinance entitled “An ordinance amending Chapter XXI of the Grand Forks City Code relating to wine and beer makers license”, which had been introduced and passed on its first reading on August 6, 2001, was presented and read for consideration on second reading and final passage.
A staff report from the Finance Department relating to the application for a Class 14 Wine and Beer Maker license by Maverick Enterprises, LLC dba Vintner’s Cellar, 1726 South Washington Street, with recommendation to approve second reading of the ordinance and approve the issuance of the Class 14 license subject to sign off by appropriate departments and approval of the city attorney.
Howard Swanson, city attorney, pointed out a minor change in language which he doesn’t believe is substantive, the text of Class 14 Wine and Beer Maker license, one sentence has been changed to add the phrase “total size” and would now read “…A license holder shall be authorized to offer complimentary samples of beers produced on the premises provided that the total size of all samples not be in an amount exceeding sixteen (16) fluid ounces per patron.” He stated that is consistent with State law, otherwise the ordinance is as previously presented, and recommended approval of the amendment and final approval to the second reading.
It was moved by Council Member Hamerlik that we insert the words as indicated by the city attorney and seconded by Council Member Kerian. Carried 10 votes affirmative.
Council Member Gershman asked to be excused from voting on this matter. It was moved by Council Member Brooks and seconded by Council Member Hamerlik to allow Council Member Gershman to abstain from voting on this issue. Carried 9 votes affirmative.
Upon call for the question of adoption of second reading of the ordinance, as amended, and upon voice vote the following voted “aye”: Council Members Brooks, Bjerke, Stevens, Hamerlik, Christensen, Kerian, Kreun, Martinson - 8; voting “nay”: Council Member Bjerke - 1; and Council Member Gershman abstaining. Mayor Brown declared the motion carried and the ordinance adopted.
APPROVE CLASS 14 WINE AND BEER MAKER LICENSE
TO MAVERICK ENTERPRISES, LLC DBA VINTNER’S CELLAR
The city auditor presented the application for Class 14 Wine and Beer Maker license by Maverick Enterprises, LLC dba Vintner’s Cellar, 1726 South Washington Street.
Mr. Swanson reported he had reviewed the application and it appears to be in order and it is his recommendation that the council approve it contingent upon final inspection and approval by the Inspections Department, Fire Department, and Health Department; and it was so moved by Council Member Hamerlik and seconded by Council Member Martinson. Carried 8 votes affirmative; Council Member Bjerke voting against the motion; Council Member Gershman abstaining.
ADJOURN
It was moved by Council Member Kreun and seconded by Council Member Martinson that we do now adjourn. Carried 10 votes affirmative.
