MINUTES/PUBLIC SAFETY COMMITTEE
Monday, April 11, 1994 - 3:45 p.m.
Members present: Crawford, Geller, Hoeppner.
1. Request by Sertoma Club to hold fireworks display and duck
race during July 4th celebration.
Tony Aymond and several other reps. of Sertoma Club were present, stated there was not much change from last year except additional security (Air Base and Highway Patrol); that there will be more activities on east side of river, incl. beer gardens and bands (may also have beer garden in court behind Windmill). He noted that last year they had problem with people wanting to cross RR bridge, and will have security on both sides. He stated they are contracting with bus co. for shuttle service between east and west sides. Moved by Hoeppner and Crawford to approve request. Motion carried.
2. Application by Schoeppner Shows for carnival permit at South
Forks Plaza Mall May 5-15, 1994.
Ken Schultz, health department, stated his department has no problem with this application, and that company posts bond to insure cleanup of area. Moved by Hoeppner and Crawford to approve application. Motion carried.
3. Application by L.T.D. Investments, Inc. for transfer of
alcoholic beverage license at 10 North 3rd Street.
Lloyd Sampson, 3608 11th Avenue North, applicant, was present. Mr. Swanson, city attorney, advised he had reviewed application (incl. Sunday ap.) and it is in order. Moved by Crawford and Hoeppner to approve subject to final approval by the fire, police, health and building departments, and subject to taxes being current. Motion carried.
4. Application for renewal of Class 10 Excursion Boat alcoholic
beverage license by Dakota Queen, Inc. dba Dakota Queen
Riverboat.
Moved by Hoeppner and Crawford to approve the application (incl. ap. for Sunday operations), subject to final review by the health, fire, police and building departments. Motion carried.
Geller reported present.
5.
Matter of crossing South Washington Street.
Glenna and Jack Leedahl, 128 Sleepy Hollow, stated their concern is safety of children crossing South Washington on way to Apollo Park for baseball, to Tennis Center, for children on west side of Washington to get to Water World, Lincoln Park golf course, Elks swimming pool, - children crossing Washington to get to summer activities; that their son was involved in bike-car accident last summer; and they are apprehensive, and are asking City to look into. Mrs. Leedahl stated City has wonderful facilities for children, but that safety in crossing Washington is a real concern. The committee stated they are somewhat

limited in what can do as Washington Street major arterial. Mr. Leedahl stated they have discussed concern with number of people, know that it is impossible to make everything risk free, but is a real concern with increased traffic, and suggested some sort of overpass; and that possibly Park District could assist in paying costs. John Thompson, traffic engineer, stated that preliminary studies underway for reconstruction of S. Washington Street, that Dept. of Transp. will start having input meetings and that he will make sure they look at pedestrian crossings. However, he stated that if can't insure that most pedestrians use that facility (over or under grade structure), DOT wouldn't consider. He also suggested initiating city-wide pedestrian plan (something like bikepath plan), studies done by MPO to address future needs. The committee suggested that when public hearings held on S. Wash. St. reconstruction project, that they get people to meetings. Mr. Thompson stated that DOT probably start hearings this fall. The committee also suggested that Mr. Thompson extend "walk" and yellow cycles for east/west traffic at those intersections (17th, 24th).
6. Request by Paul Lester, Dakota Queen, for change in fee for
Class 10 license.
Paul Lester stated that under new liquor regulations, fee increased to $1,000; that two years ago regs. changed to allow service of alcoholic beverages when boat tied at dock and license fee raised, that this isn't something that has worked out, and asked that fee be changed back to $550. Mr. Swanson stated he can't see increase in any way tied to that provision, and advised leaving provision and amending fee; sees no need to amend text. He also noted that this is a seasonal license, and that other seasonal licenses are $550. Moved by Hoeppner and Crawford to introduce ordinance to reduce fee for Class 10 Excursion Boat alcoholic beverage license from $1,000 to $550, and that an ordinance be introduced for first reading. Motion carried.
7. Matter of marking fire lanes with red paint and increasing
fine for illegally parking in fire lanes.
Dick Westacott, fire inspector, presented request and stated that lanes completely ignored. He suggested an effective date of September 1, and a fine/fee of $50.00. Capt. Brown, police dept., stated that most fire lanes on private property and they don't patrol on regular basis on private property; suggested special policing for fire inspectors who see violations and could issue tickets.
After further discussion it was moved by Hoeppner and Crawford to amend the City Code to require marking of fire lanes with red paint, signing of the lanes, that penalty for violation be increased to $50.00, that the ordinance have an effective date of September 1, 1994, and further to introduce the ordinance for first reading. Motion carried.

Application for gaming permit:
a) Development Homes, Inc. - site auth. at 10 N. 3rd Street.
Site is at new liquor establishment at 10 N. 3rd; and application had been reviewed and approved by the city attorney. Moved by Crawford and Hoeppner to approve the application. Motion carried. (committee only)
9.
Matter of gophers.
Several residents of Chateau Condos were present. Ken Schultz of health department, reported that property owners at Chateau Condos are having problem with gophers, that he had been out there and there's LOT of gophers there. He reported that Dwight Wurzbacher, water maint., has contract for pest control in area of underground water tank, and other property in area belongs to Park District, that they have two full-time employees who work on that all summer long, and they will try to get out to that area (undergrowth etc.) He stated there should be follow up on this matter at later date. It was also noted that there is strip of land north of Chateau Condos #400 (2 lots) owned by individual living in Jamestown, and need to keep that area cut. Mr. Schultz also reported that the Park Dist. uses pesticide which is very effective and which can be obtained locally. He also reported that Mr. Wurzbacher and the Park District will get started on this right away. Moved by Crawford and Hoeppner to receive and file. Motion carried. (committee only)
10. Application by J.E.P., Inc. dba Fabulous Westward Ho for
special alcoholic beverage license for special event.
An application by Westward Ho for special license for event off designated premises - 121 North 5th Street for Tau Kappa Epsilon social and dance on April 22, 1994 was presented. Mr. Swanson reviewed application and stated he has no problem with application. Moved by Crawford and Hoeppner to approve. Motion carried.
