MINUTES/PUBLIC SAFETY COMMITTEE
Monday, October 10, 1994 - 3:45 p.m.
Members present: Hoeppner, Johnson, Sande.
1. Request by Boy Scout Troop 130 for refund of temporary
restaurant license fee.
Moved by Johnson and Sande to approve refunding of the $25.00 fee. Motion carried. (committee only)
2. Request by GF Park District to hold 11th Annual Black Cat
Run/Walk on Saturday, October 29.
Dick Leker of the Park District reported the route is the same as for the previous ten years; Chief Paschke stated they have no objections. Moved by Sande and Johnson to approve request subject to signing of an indemnity and hold harmless agreement, and coordinating the event with the police department. Motion carried.
3. Matter of removing no-parking zone signs north of UND campus
due to proper street widths and difficult parking situations.
John Thompson, traffic engineer, presented recommendation to receive and file based on communication from UND police stating they are not in favor of the request and from Street Department personnel stating concerns re. snow removal. It was also noted that according to UND Police a new parking lot is opening in this area soon. Moved by Johnson and Sande to receive and file. Motion carried.
4. Matter of requested changes at intersection of 42nd Street
and DeMers Avenue.
The communication from Mark Frovarp, UND Police, requesting decrease in speed limits prior to intersection of 42nd Street and DeMers, that the speed limit for north bound traffic on S. 42nd Street is 45 mph and changes to 30 mph just after the intersection and the railroad tracks, that the left turn traffic for all four directions is not light-controlled and recommended controls of the type located at Gateway Dr. and Stanford or 17th Ave.S. and Columbia Rd. Mr. Thompson recommended approval of change in speed limit as requested, and to receive and file additional left turn phasing request. He reported that the traffic signal was recenlty redesigned and constructed, that left turn phasing was considered at that time but warrants not met. He also noted that the signal has been constructed for quick conversion to allow left turn phasing and will be modified at such time as the traffic volumes warrant.
It was moved by Sande and Johnson to reduce speed limit South 42nd Street to 30 mph just prior to its intersection with DeMers Avenue, and to receive and file request for additional left turn phasing request. Motion carried.
5. Petition for school crossing light at intersection of Cherry
Street and 22nd Avenue South.

Susan Kraft, 1521 Chestnut Street, and Lorrie Zaharia, 2608 Chestnut Street, were present.
Mr. Thompson's result of survey, which was done over several days, shows that minimum delay required was not exceeded at any time during the second study. He stated they would study each year until it meets warrants, delay time (time between vehicles crossing in either direction)
Chief Paschke reported the police department has done selective enforcement from 28th through 7th, with a number of citations issued; that when they are there, traffic tends to slow down.
Moved by Sande and Johnson to receive and file.
Ms. Zaharia asked if City could hold public forum of parents, teachers, etc. to make public more aware of the problem. Chairman Hoeppner noted that Mr. Stenjem will be introducing legislation to relieve School Board, teachers, etc. of liability for school patrol program, and if passed by Legislature, school system could get involved with police department for school patrol program.
Mr. Johnson suggest that they consider doing somthing through PTO's, get input from police department, and come back with suggestions, etc. Mrs. Sande also suggested they lobby their legislators, and to contact Council Member Beyer who is organizing group at Viking School.
Upon call for the question the motion carried.
6. Matter of removing no-parking zone signs north of UND campus
due to proper street widths and difficult parking situation.
Chad McCabe, council member, asked committee to reconsider item 3; and stated he had reviewed letter from UND and questioned the last paragraph which stated "Presently there are vacant spaces available throughout the day at the tennis court lot (6th Ave.N.),..." and they "..see no need to create an unnecessary temporary parking situation when there will be more spaces on campus available shortly, and that there are spaces and services available presently." Mr. McCabe stated there is no parking available until 3:30 p.m. in the tennis court lot, and sees no problem with reinstating parking on 5th Avenue North; that this is 31 ft. street and sees no problem with parking on one side of the street. There was some discussion that parking is allowed on 5th Avenue North with exception of about a two-block area, which is narrower (one-half block for postal service). Chief
Czapiewski, UND Police, stated that because of construction, large part of lot taken up, which should be available shortly, and that usually there is decline in number of vehicles at this time of year (students take cars home, hunting season over, etc.)

He stated there is problem with cars trying to back out onto narrower streets and even with one lane of parking, concerned re. fire trucks trying to get through.
Bob Kvitne suggested possiblity of putting up parking ramp in that area. Mr. McCabe stated there are no funds; and Mr. Kvitne suggested City and UND split cost, that UND requires students to have parking permits and no parking available. Chief Czapiewski stated they only over-sell by 8%, all students not attending classes same date at same time. Held for 2 weeks, with street width to be researched.
6.
Applications for gaming permits:

c) Lincoln School PTO - bingo November 15
d) Lincoln School PTO - raffle October 28
e) United Hospice - raffle November 29
f) Red River R/C Flyers - raffle March 4
All applications had been reviewed and approved by the city attorney. Moved by Johnson and Sane to approve the applications. Motion carried.
7. Request by police department to purchase bomb suit jointly
with UND police.
Chief Paschke stated that UND police and City police jointly as a team do explosive device removal, have total of 3 trained personnel; Feds. mandated in order to be trained and certified as demolition person they must wear protective suit; do have money for it through cash carryover - purchase jointly with UND. They have provided letter of agreement. He stated there are three companies which make these suits all accordinag to federal standards and little difference in price - from $9600 to $9975 (cost split between City and UND) and are requesting authorization to purchase sole source because of preference of suit, and difficulty in writing of generic specs. Moved by Johnson to approve contingent upon approval of the city attorney; the motion was seconded by Sande. Motion carried. (comm. only)
8.
Matter of budget amendments.
a) Fire Department - $5,000 - from 1993 pooled cash carryover to Cars & Light Duty Trucks.
b) Health Department Community Immunization budget - $3,000 Knight Foundation Grant.
Moved by Hoeppner and Sande to approve budget amendments, and to introduce ordinances amending annual appropriations bill ordinance for first reading. Motion carried.
