MINUTES/FINANCE COMMITTEE
Monday, September 25, 1995 - 6:00 p.m.

Members present: Carpenter, Babinchak, Geller.

1. Matter of riverboat lease re. location for securing boat
during winter months.
Eliot Glassheim reported that the original motion by River Forks Commission was to locate down the river at Sorlie Bridge, that basically Mr. Lester wanted their costs to be less, access to phone line sensors which will tie into police department; used as advertisement because so visible, on high ground per insurance company; other sites would cost additional monies, $5,000; and Commission thought give year's trial with conditions as listed.
Mr. Glassheim stated that Mr. Vein also had concern re. flood if on permanent basis, that aesthetics were also concern as Mr. Lester would do maintenance there. He reviewed conditions agreed to in meeting with Mr. Lester. Mr. Vein expressed concern as he hasn't seen site plan, that this is also concern when City looks at permanent flood protection, may have to submit plan to Corps of Engineers. Mr. Lester stated he has authorization from the Corps.

John O'Leary reported they worked on plan with Mr. Lester, found several sites which would work, but additional expense to him; and suggested moving 15 ft. to the north because of fruit tree and pine trees planted there; that several trees were removed and Mr. Lester wanted to move several more; He stated that trees 16-18 ft. and wouldn't think it would be problem to move site; that it was his understanding that the fence would be removed but trolley remain and may need some additional landscaping for that site. Mr. O'Leary reviewed other sites with the committee.

Mr. Swanson, city attorney, stated this was not a permitted use and would have to amend lease to do that, and suggested hold harmless agreement and some type of insurance.

Mr. O'Leary reported that there was understanding with Mr. Lester that no additional work be done until plans and specs. reviewed by the engineering department; and need to have understanding re. landscaping, maintenance purposes, etc.

Mr. Swanson stated that lease will have to be modified, doesn't include storage.

Mr. Lester agreed with engineer, and is willing to agree with terms discussed with River Forks Commission, and agreed to change location.

Moved by Geller and Babinchak that the City sign an agreement with Paul Lester, Dakota Queen, Inc., allowing storage of the Dakota Queen up the bank from its normal point of departure (western boundary to be the McPherson lot) for one year and allowing railroad tracks from water's edge to this site,

contingent upon the following: 1) approval of plans and specifications by the engineering department, with timely consideration; 2) signing of a hold harmless agreement with the City; 3) agreement by Paul Lester that this approval if for one year only and request must be made annually to the River Forks Commission and the city council for renewal; 4) agreement by Paul Lester that he will move the tracks and any fencing upon six months notice to vacate, at no cost to the City or River Forks and that he will restore the terrain to its original condition at his cost; and 5) that the section of track going over the bikepath will be temporary and will be laid down only during the moving of the boat from water to land or land to water; and including indemnity clause and to angle tracks to minimize impact on existing trees. Motion carried.
