MINUTES/PUBLIC SAFETY COMMITTEE
Monday, June 26, 1995 - 3:45 p.m.
Members present: Hoeppner, Sande.
1. Request by DAV Auxiliary and DAV Chapter to sell "forget-me-
not" posters August 28-September 9 and flowers September 9.
The committee noted that this is an annual request. Moved by Sande and Hoeppner to approve request. Motion carried.
2.
Request for refund of temporary restaurant license fees:
a) Greater Grand Forks Soccer Club for 1994 and 1995.
Moved by Sande and Hoeppner to approve requests for refund ($40 for 1995 and $25 for 1994). Motion carried. (committee only) (Note: under City Code and per city attorney's office the request for refund must be made within 30 days of license period and request for refund for 1994 does not meet requirements and fee will not be refunded).
3.
Matter of unleashed dogs at Park Manor Trailer Park.
Handled administratively.
4. Matter of traffic control in "drive through area" between
Valley Dairy and B & H Motel.
Clyde Varnson was present and asked for blocking of the alley; he maintains the area. The committee read the traffic engineer's report and recommendation: that the City maintains a sanitary sewer line in the alley that proceeds onto the BNRR property and NSP has utility poles and primary underground lines in the alley; that the city engineer has requested that consideration of the vacation of the R/W between 11th Ave.N. and the BNRR property be submitted through the public service committee as is the customary procedure; and that the city engineering office does not recommend vacation of the right of way between the B & H Motel and the Valley Dairy at this time.
Moved by Sande and Hoeppner to approve the traffic engineer's recommendation. Motion carried.
5.
Matter of Chaps liquor license.
Larry Stauss and Grant Shaft, attorney, were present. The committee reported that they had reviewed information in the packet from Mr. Shaft requesting extension from July 1 to November 30, 1995; copies of letters from various contractors stating that the work will be completed by November 30; and noted that fees are current. Moved by Hoeppner and Sande to allow an extension to November 30, 1995. Motion carried.
6. Matter of agreement with ND State University re. dietetics
graduate program.
Wally Helland reported that this is basically an intern program with NDSU. Howard Swanson reported that he has reviewed agreement and it is acceptable. Moved by Sande and Hoeppner to approve the agreement. Motion carried.

Applications for gaming permits:
a) St. Mary's Church Altar Society - raffle 9/24/95
b) AID Assn. for Lutherans, Branch 1193 - raffle 10/29/95
Applications had been reviewed and approved by the city attorney. Moved by Sande and Hoeppner to approve the applications. Motion carried. (committee only)
8.
Temporary and overtime statement for May, 1995.
Moved by Sande and Hoeppner to approve the temporary and overtime statement. Motion carried. (committee only)
9. Request from Norm Hobin, 732 N. 5th St. for "no parking here
to corner" sign in front of 802 North 5th Street.
The traffic engineer's report and recommendation for approval of the request was presented and read. Moved by Hoeppner and Sande to accept the traffic engineer's recommendation for approval. Motion carried.
10. Applications for special alcoholic beverage permits by
Westward Ho.
a) at Capuccino Gardens, 215 S. 3rd Street, July 4 from 12:00 noon to 12:00 midnight.
b) at DJ's, 121 North 5th Street, July 22 from 8:00 p.m. to 1:00 a.m.
Scott Lindgren was present. Mr. Swanson reported he had reviewed applications and they are in order. Moved by Sande and Hoeppner to approve the applications. Motion carried.
11. Matter of status report by Sertoma Club re. July 4 activities
and request for exclusive control of vendors.
Bob Hankey and Dave Keller, rep. Sertoma Club, were present. It was reported that request for use of the riverbank on July 4 had been approved, however, they did not know if specific request for exclusive control of vendors had been granted. Mr. Swanson advised that under request they would have ability to authorize or exclude vendors from the premises (boundaries are the river on the east, the alley on the west, Sorlie Bridge on the north and the Point Bridge on the south), that they have criteria for vendors to meet. He also advised that they would not have control away from the riverbank.
Moved by Hoeppner and Sande to approve request by the Sertoma Club for exclusive control of vendors for the July 4 activities on the riverbank. Motion carried.
12. Request for special alcoholic beverage permit by The Edge for
beer garden using lot next to 10 N. 3rd St. on August 20.
Christine Sanders, 317 DeMers, rep. The Edge, presented request to use part of lots in the parking lot for a beer garden during Grand Prix event on August 20; that they have talked to

Dick Jackson, CBD Auth. and he suggested they come to Safety Committee first and if receive permission bring request back to them. Mr. Swanson advised committee that The Edge would need special permit to sell alcoholic beverages outside designated premises, and would need to contact Central Business Dist. Auth. whether they could use parking lot.
Moved by Hoeppner and Sande to approve the application. Motion carried.
13.
Applications for gaming permits:
a) IOOF and Auxiliary - raffle 12/20/95
b) St. Mary's Men's Club - bingo for year ending 6/30/96.
c) ND Dental Hygiene Assn. - raffle 9/09/95
d) Raymond W. Quesnel Aux. to Post 1874 - bingo Oct. 12, 19 and 26, 1995.
All applications had been reviewed and approved by the city attorney. Moved by Sande and Hoeppner to approve. Motion carried. (comm. only)
