MINUTES/PUBLIC SAFETY COMMITTEE
Monday, October 9, 1995 - 3:45 p.m.
Members present: Johnson, Sande.
1. Request by Bible Baptist Church for refund of temporary
restaurant license fees.
The request was for refund of fees for two separate occasions (September 22 and 23, and October 8 and 9) at $40/ea. for a total of $80.00. Moved by Sande and Johnson to refund the fees for temporary restaurant licenses. Motion carried. (Comm. only)
2. Request by UND Women's Center to hold "Take Back the Night"
march on October 10.
Nancy Cashman, 421-B Squires Hall, stated this is night dedicated towards women against any form of violence, this is awareness week at UND and reported they would be marching on designated route on campus (on sidewalks) for approx. half an hour; and have notified UND police. Moved by Sande and Johnson to approve request. Motion carried. (comm. only)
3. Request for change in parking on 15th Avenue S. at S. 14th
Street.
Donna Whaley, 1506 S. 19th Street, stated that 15th Ave. has an apartment complex on both sides, they have adequate off-street parking, but use streets for convenience; that it's difficult to see traffic coming from west to east because cars parked to corner. John Thompson, traffic engineer, reported he looked at area and is as stated, could remove parking on both sides of 15th Ave.S. for about 60 ft. (no parking here to corner), and would suggest for S. 14th Street as well, this would clear inter- section. Member Johnson expressed some concern re. removing parking without notification to apartment dwellers. After further discussion it was moved by Sande and Johnson to remove parking from south side of 15th Ave.S. for 60 ft. from its intersection with 14th Street. Motion carried.
4. Matter of agreement with United Hospital re. Infectious Waste
Disposal.
Don Shields, director of health department, reported this is basically same agreements as have had for last three years, with same costs, allowing proper disposal of infectious wastes (syringes, etc.) and recommended approval. Moved by Sande and Johnson to approve agreement for disposal of infectious waste materials. Motion carried.
5. Matter of agreement with ND Department of Health and Traill
District Health Unit for Maternal and Child Health Nutrition
Special Initiative.
Mr. Shields reported this is a new agreement, agreement being reviewed by the city attorney, and which allows the health de-partment to provide nutrition services to five schools in Traill County; that the State has given them approx. $1500 to do that (education supplies, travel and salary), and requested approval

contingent upon approval by the city attorney. Moved by Sande and Johnson to approve the agreement contingent upon approval by the city attorney. Motion carried.
6.
Matter of budget amendments:
a) Wellness Program (Traill Co. Nutrition Project) - $1500 grant (as noted above)
b) Communicable Disease - $700 grant received from Aid Assn. for Lutherans to assist with immunization coalition activities.
Mr. Shields reviewed the amendments. Moved by Sande and Johnson to approve. Motion carried.
7.
Applications for gaming permits:
a) Student Nurses Assn. of North Dakota - raffle 02/11/96
b) Quad County Community Action Agency - raffle 11/15/95
c) Wilder Elementary School - bingo/raffle 11/14/95
d) Belmont School PTO - bingo 11/17/95
e) UND Indian Assn. - raffles/bingo for period ending 6/30/96
It was noted that the city attorney had reviewed and approved the applications. Moved by Sande and Johnson to approve the applications for gaming permits. Motion carried. (comm.only)
8.
Applications for special alcoholic beverage permits:
a) El Roco Lounge, Inc., 615 1st Ave.N. (civic auditorium)
on November 4 and 5, 1995.
Paul Endres was present. It was noted that the city attorney had reviewed and approved the application for permit. Moved by Sande and Johnson that the application be approved. Motion carried.
b) Happy Harry's, 615 1st Ave.N. (civic auditorium) on
November 4 and 5, 1995.
Hal Gershman was present. It was noted that the event being catered is the Holiday Food Fest; and that the application had been reviewed and approved by the city attorney. Moved by Sande and Johnson that the application be approved. Motion carried.
9.
Application for gaming permits:
a) UND Student Medical Technology/CLS Club - raffle 12/04/95
The application had been reviewed and approved by the city attorney, contingent upon adoption of a resolution recognizing this organization as a public-spirited organization eligible to conduct games of chance. It was moved by Sande and Johnson to move a resolution recognizing this group as a public-spirited organization eligible to conduct gaming. Motion carried.
It was moved by Sande and Johnson to grant the application for a gaming permit. Motion carried.
10.

It was reported that all applications had been reviewed and approved by the city attorney. Moved by Sande and Johnson to approve the applications for gaming permits. Motion carried. (Comm. only)
11.
Budget amendments:
a) Police Department - $35,904 (from cash carryover to cover costs of step increases for 1995)
b) Police Department - $25,291 (from cash carryover to cover retroactive pay for police)
c) Police Department - $1,100 (to reflect increased revenue from Traffic Safety Grant)
d) Police Department - $50,122 (from cash carryover to cover retroactive pay for police)
e) Police Department - $7,236 (to increase revenue for police overtime that has been billed)
e) Emergency Management - $16,800 (to reflect increase in revenues from grant)
f) Public Building Fund - $68,000 (from cash carryover to cover purchase of land for fire station)
g) Special Grant - First Night - $85,528 (to reflect additional revenues for First Night)
The committee reviewed the budget amendments.
Moved by Sande and Johnson to approve the budget amendments as detailed. Motion carried.
12. Matter of request for no parking on S. 34th Street from 24th
Avenue South to south of Carrington Court where curb and
gutter ends.
Member Sande reported that Council Member Babinchak had concerns re. parking on portion of South 34th Street where paving narrows (with no curb and gutter) and would like to have no parking signs on both sides of that street from that point to 24th Avenue South; that street is extremely narrow and will get worse in the winter. Mr. Thompson concurred with recommendation. Moved by Sande and Johnson to install no parking signs on both sides of South 34th Street from point where curb and gutter ends to 24th Avenue South. Motion carried.
13.
Informational item - re. safety problem.
Member Sande reported she had received copy of memo from Human Resources (safety group) about sidewalks and cleaning of sidewalks at police building on weekends during the winter with snow removal not done until Mondays, and expressed some concern re. number of injury claims (6 - 8 claims) because of snowy/icy conditions of the sidewalk in that area. Chief Paschke reported
they have people there on weekends; that he has knowledge of two

claims, which have been addressed. Chief Paschke did report that the parking lot at the back of the building built on a slope, that they do sand it, but have had some slips and falls, and some problem with vehicles backing out. He also recommended that when time comes to resurface lot, etc. that it be leveled. No action.
