Monday, August 14, 1995 - 7:00 p.m.
Members present: Beyer, Hamerlik, Klave.
1.
Applications for moving permits:
a) Don Wurzbacher - to move building from 1213 Belmont road to 2203 Chestnut Street.
Dean Jacobson and Walt Orchard were present. Bruce Melin, bldg. inspector, reported that Mr. Wurzbacher brought in moving permit from the County to move building out of town by Saturday or by end of August. Mr. Swanson advised that their previous recommendation had not been acted upon by the council but referred back to committee, and committee free to alter that recommendation. Moved by Klave and Hamerlik that based upon the action of the property owner by applying to move structure outside the city limits, to receive and file application for moving permit. Motion carried.
b) Mark Wedin - to move building from 1305 5th Avenue North to 1102 24th Avenue South (garage).
Bruce Melin, bldg. inspector, reported that garage needs some repair (new slab, paint, replace cracked window, repair bi-parting door and other miscellaneous repairs). Moved by Hamerlik and Klave to approve the application subject to the public hearing. Motion carried.
2. Matter of billing for removal of tree branches (Paul Riley,
1602 South 19th Street).
Handled administratively.
3.
Request for authorization to call for bids:
a) crawler-tractor at sanitation
Dick Newman, solid waste mgr., reported they are requesting authorization to replace 1965 D-6 crawler with an updated model, that they are looking for something between 5 to 10 years old, around 10,000 hours, to be used couple times a week on an average; they need something bigger than what they have for moving dirt for landfill closure, to handle increased load, and to move water sludge around, est. cost $100,000 to $150,000, with money to come from unanticipated landfill revenues and budgeted money for landfill compactor that will not be purchased this year. He also reported they will be bid some type of warranty on the machine. Moved by Hamerlik and Klave to authorize call for bids. Motion carried. (committee only)
b) roof repair at sanitation buildings on Mill Road
Mr. Newman reported they have several leaks on roof (into electrical outlets along wall), that they requested quotes from four companies, two responded, and asking authorization to award bid to Skinner Roofing in the amount of $6,000 (repair areas that need to be repaired, building needs new roof but that's out of line, $65-80,000), quotes sent out several weeks ago. Ken Vein, city engineer, reported this situation little bit different,

getting leakage into electrical outlets, emergency basis. Moved by Hamerlik and Klave that due to emergency, they accept bid of Skinner Roofing in the amount of $6,000.00. Motion carried. (committee only)
4.
Matter of consideration of bids:
a) Proj. 4364, Dist. 362, san. sewer on 6th Ave.N.
b) Proj. 4365, Dist. 240, watermain on 6th Ave.N.
Al Grasser, asst. city engineer, reviewed tabulation of bids received for Sewer Project No. 4364 and Watermain Project No. 4365 (combined bid), and recommended award to the low bidder, Soberaski, Inc. Moved by Klave and Hamerlik that we accept the low bid of Soberaski, Inc. in the amounts of $64,165.00 and $49,175.00 for Sewer Project No. 4364 and Watermain Project No. 4365, respectively, for a total bid of $110,340.00. Motion carried.
5.
Matter of plans and specifications:
a) Proj. 4255, Dist. 531, paving 26th Ave.S. and S. 21st St.
Mr. Grasser reported this paving requested by developer, Dan Mikkelson, and reviewed plans and specifications for paving (and some storm sewer) and paving interconnect. Moved by Klave and Hamerlik that we pass a resolution approving the plans and specifications for this construction and further that the city auditor be directed to call for bids on the project. Motion carried.
7.
Matter of change orders:
a) C.O. #3, Proj. 4263, 1995 asphalt street repair
Mr. Grasser reviewed change order to include portion of South 42nd Street between University Avenue and DeMers Avenue, that this street has deteriorated over summer months and needs to be reconstructed but need to keep functional until reconstruction next year; that change order includes grading, compacting and thin layer of asphalt, at cost of $5,595. Moved by Klave and Hamerlik to approve the change order in the amount of $5,595.00, with funds to be paid from Highway Users Maintenance Acct. Motion carried.
b) C.O. #'s 1 and 2, Proj. 3821, Sch.B, Richard's West storm sewer
Tom Hanson, Webster, Foster & Weston, reviewed change orders: C.O. #1 (deletion of san.sewer - boring under roadway) for deduct of $6,394.00 and C.O. #2, increased compaction of backfill for RCP storm sewer on 6th Ave.N. for an increase in project cost of $26,730.00, with funds to be taken from project contingencies, Comm. Development will verify if this is eligible under grant funding, if not, special assessed to property owners.
Moved by Klave and Hamerlik to approve the change orders. Motion carried.

c) C.O. #1, Proj. 4250, Bikepath along S. 34th Street
d) C.O. #1, Proj. 3947, Bikepath along English Coulee
Al Petrick, CPS, Ltd. reviewed change orders to add center- line joints on both projects (reduction in panel size from 10'x10' to 5'x7') which requires additional saw cutting because bikeways with 10'x10' panels have developed random cracks; that reconstruction of roadway (S. 34th St) adj. to bikeway is scheduled for 1996, and during reconstruction heavy equipment will be required to operate near the bikeway and may cause random cracking of the larger panels. He reported they have negotiated change orders with contractor, Nodak Contracting.
Moved by Hamerlik and Klave that C.O. #1, Project No. 4250, in the amount of $3,999.90 be approved. Motion carried.
Moved by Hamerlik and Klave that C.O. #1, Project No. 3947, in the amount of $6,432.00 be approved. Motion carried.
e) C.O. #1, Project No. 4262, 1995 concrete street repair.
Mr. Grasser reported that the School Dist. concerned with traffic problems, that with remodeling and with 9th graders coming in, about getting students in and out of Red River area, and are asking for right turn lane at 17th Ave.S. and S. 25th Street; that roadway isn't wide enough to do with stripping and they are proposing to add right turn lane on 25th Street with left turn and inbound lane into 25th. He reported that the School District has agreed to pay costs for right turn lane and Park District also agreed to participate in cost; that the School Dist. is asking to get this done before school starts and eng. is proposing to add as change order to the concrete street repair project.
Moved by Hamerlik and Klave to approve the change order to install right turn lane in the amount of $19,508.50, to be paid in cash by School District, contingent upon communication from School District agreeing to payment and granting of easement for the sidewalk. Motion carried.
6.
Matter of creating special assessment district:
a) Proj. 4340, Dist. 238, watermain on S. Washington Street
Tom Hanson, Webster, Foster & Weston, presented map showing city's distribution system that are 10" or larger; that in 1984 City hired their firm to do an analysis of the water system and master plan study, and asked that they look at sizing for growth areas and what's best way to make sure they have adequate main sizes in growth areas. He stated that after they completed the hydraulic analysis, their recommendation was that section line areas be sized with 16" main, and the quarter lines that split the section be sized with 12" mains; that since that time the City has stayed with that plan (12" line through Tech. Park because that's quarter line, the portion serving Conte Luna 12"

main). He stated that the area working with now is from 28th to
40th Aves. South, that large portion of this area developed before this plan was in hand, so an area served with 12" mains but 16" not through there. He stated that one thing they found was that sizing of the watermains was dependent upon being able to transmit water from the water plant and from the 7MG reservoir to the water towers around the community, and that's critical thing in sizing is to have low enough friction loss across the community so will flow without having to have separate pressure zones, pumping and valving and lot of additional maintenance and operating costs for the City; so in looking at this need to look at future water tower sites and how to get water to those, and the 12" and 16" main scheme works very well to continue to do that. He stated that there is a water tower tentatively planned a mile and a half south of 32nd Avenue South and another one between University and DeMers on 55th Street.
Mr. Grasser presented brief history of the project which was first proposed in 1991; that in April of 1994 council delayed construction for one year, to late fall of 1995 and to be assessed in 1997. He reported that the scope of work has changed because of new development (Forks Rent-All and others) in the south end and in order to maintain flows and pressures and fire protection velocities, need to go loop system to enhance fire protection capabilities to the south.
Mr. Grasser reviewed engineer's report and assessment district boundaries, that they have taken adj. properties into the district, that there are some tapping areas where watermain will pass but are not in the city limits (south side of 40th Ave.S. and south of 36th Ave.S.). It was also noted that Sunset Gardens has been eliminated from the district because would end up putting in two parallel lines (one on west and one on east) and with this method able to serve the needs of all properties with only one line; that this is most cost effective and efficient method to serve that area.
He reviewed costs outlined in engineer's report, total cost est. $552,500.00; and noted that under the City's current policy it pays material cost over 8" main, and are estimating City's share of $75,000. He reported that there will be 12" main from 28th to 32nd, 16" from 32nd to 40th, 12" on 40th to Clearview Drive, and some 8" on 38th (in which City doesn't participate); and included in the $552,500.00 total est. cost are $108,000 in tapping fees to be carried by the City.
Mr. Vein reported that when doing annexation of properties they request expanded areas to cut down on tapping charges.
Greg Norman, 2950 South Washington Street, property owner, was present. (Mr. Norman received call and had to leave). He was

advised that the committee may take action, but he will have an
opportunity to appear on this item before council on Monday night.
Tom Hanson, WFW, reported he had met with Mr. Norman and reviewed project and need for project, and his concern was with special assessment costs.
Mr. Vein recommended proceeding with project and keeping on schedule, but doesn't want to proceed with project if they don't have intentions of going on.
Mr. Grasser reported that they don't know what individual costs are going to be until Special Assessment Commission meets, and they won't look at it until the district is created; that they will do a preliminary distribution of benefits. Mr. Grasser also reported that in theory, and in general, property owners reap some benefit in larger project, but in general, doesn't matter, costs x-dollars to run main past your property; that project won't be done in time to be certified until 1996.
Moved by Klave and Beyer that we adopt a resolution creating the assessment district, approving the engineer's report, including estimate of cost, an assessment district map, and further that we pass a resolution instructing the city engineer to prepare detailed plans and specifications, and that we declare intent to sell bonds to finance these improvements. Motion carried.
5.
Matter of plans and specifications:
b) Paving of alley behind UND Medical Science North Bldg.
Leroy Sondrol, UND Plant Services, presented matter of alley paving behind Medical Science North Bldg.
Mr. Grasser reported they had received request from Mr. Sondrol for paving that alley (that this was considered several years ago for special assessment project, and property owners on the west side were concerned, and project didn't proceed) with UND looking to pick up costs. It was noted that UND generates 90% of traffic through this area. He reported that he has reviewed drawings with very little comment, UND would do work through their contractor. Mr. Swanson advised that they have some type of agreement. Moved by Klave and Hamerlik to authorize entering into an agreement with the University for private construction of the alley paving, to authorize University of North Dakota to enter into City right of way, and to approve plans and specifications for the project. Motion carried.
8. Matter of impact of car wash on Washington at 4th Ave.N. on
residential property values.
Ragnar Bergendahl, 1210 4th Avenue North, appeared before committee and stated he was representing neighbors, re. Valdak

building car wash at 4th Avenue N. and N. Washington Street, that property owners did not receive notice of variance before the Board of Adjustments. He stated they had talked to an attorney re. their options, however, building already built, and they are concerned re. impact on property values.
Mr. Vein reported that a variance was needed to build on that site, and variance was granted; that site plan went through Planning Office where it was approved; the building permit was issued, and Valdak did construction. Mr. Vein stated that they followed legal requirements. It was also noted that this property zoned commercial and car wash is a permitted use.
Bruce Melin, building inspector, reported that notice was published in newspaper, that variances were for landscaping, side yard setback and second front yard setback. He reported that letters were sent on initial request before Board. Mr. Bergen- dahl suggested that notices be sent certified. Mr. Swanson stated that City not required by Code, either State law or City Code, to send notices; key is publication of notice in the paper.
Mr. Swanson advised that there are means to do what Mr. Bergen-dahl asking for through abatement process, through assessing department; and the committee suggested that Mr. Bergendahl contact the assessor's office re. any impact on property valuations.
9. Application for moving permit to move building from 910 S.
11th Street to 1620 N. 4th Street to be used as garage.
Bruce Melin, building inspector, presented application by Ronald Broussard to move building from 910 South 11th Street to 1620 North 4th Street to be used as a garage; and reported that this is a 12'x20' building which needs new slab, siding repairs and gutters. Moved by Klave and Hamerlik to approve the application subject to the public hearing. Motion carried.
