PROCEEDINGS OF THE CITY COUNCIL
OF THE CITY OF GRAND FORKS, NORTH DAKOTA
Friday, September 27, 1996

The city council of the city of Grand Forks, North Dakota met in special session in the council chambers in City Hall on Friday, September 27, 1996 at the hour of 12:00 noon with President Hagness presiding, pursuant to call by Mayor Owens, which was served on all members of the council on September 26 and 27, 1996: Document No. 7167.3 - Notice.

Present at roll call were Council Members Beach, Ellingson, Hamerlik, Glassheim, Carpenter, Sande, Beyer, Babinchak, Bakken, Hafner, Hagness - 11; absent: Council Members Polovitz, Klave - 2.

President Hagness reported that the item before the council was reconsidera- tion of the language in the resolution calling for a special city election.

COUNCIL MEMBER HANSON REPORTED PRESENT

RECONSIDER RESOLUTION CALLING FOR SPECIAL
CITY ELECTION ON DECEMBER 3, 1996

It was moved by Council Member Babinchak and seconded by Council Member Carpenter to reconsider the resolution adopted by the city council at special meeting on September 24, 1996, calling for a special city election to consider the question of whether the city council should expend funds for the construction of a multi-use facility. Upon call for the question of reconsideration and upon voice vote, the motion carried.

Howard Swanson, city attorney advised that Mayor Owens had asked that the language in the original resolution be reconsidered; that the language in the last phrase in the ballot included the words "..and other revenues". Mr. Swanson submitted copies of two proposed resolutions containing the same wording as the adopted resolution with the exception of the last phrase in the ballot language: (1) "..and other non-property tax revenues" or (2) "..other revenues excluding property tax revenues".

The matter of the resolution was again before the council: Document No. 7167.4 - Resolution.

It was moved by Council Member Hamerlik and seconded by Council Member Beach that the resolution with the ballot language that reads "..and other revenues, excluding property tax revenues" be approved.

After discussion by the council, President Hagness asked for comments from the audience, there was no response.

Upon call for the question on the motion to adopt the resolution as amended and upon voice vote the motion carried 11 votes affirmative, and 1 vote against the motion by Council Member Glassheim. President Hagness declared the resolution adopted.

It was moved by Council Member Glassheim and seconded by Council Member Hafner that we do now adjourn. Carried 12 votes affirmative.
