MINUTES/PUBLIC SAFETY COMMITTEE
Monday, January 22, 1996 - 3:45 p.m.

Members present: Hoeppner, Johnson, Sande.

1. Request for change in taxi rate schedule.
Clyde and Orval Varnson, Nodak Radio Cab Co., presented their request for increase in taxi fares, that last increase was in 1989, and were requesting increase because of increased operating costs (fuel, insurance, etc.) Clyde Varnson stated that an average fare of $4.65 (using current rates) would be $6.86 under the proposed rates; increase between 30-40% however, they are still lowest in the state. (He noted that all taxi companies across the country pay same rate of insurance.) Moved by Johnson and Sande to approve increase in rates as follows: a) the meter rate for each trip will be increased from $1.25 to $1.75 for the first one-eighth of a mile; b) an increase from $0.20 to $0.30 for each additional one-eighth of a mile; c) an increase from $0.20 to $0.30 for each minute of waiting time; and d) an increase from $0.50 to $1.00 for each additional passenger; and to introduce the ordinance for first reading. Motion carried.

2. Applications for gaming permits:
a) J.Nelson Kelly Elementary School - bingo 02/16/96
b) Ben Franklin Elementary School PTO - bingo/raffle 04/23/96
It was reported that the city attorney had reviewed and approved these applications. Moved by Sande and Johnson to approve the applications for gaming permits. Motion carried. (Comm. only)

4. Applications for gaming permits:
a) Bridge Builders Club, St. Michael's Church, raffle 4/10- 4/23/96
b) Red River Lions Club - bingo/raffle on 02/03/96
c) Rocky Mountain Elk Foundation - raffle 03/30/96
d) VFW of US Post 1874 - site authorization at 4220 5th Ave.N. (Down Under Pub)
It was noted that the city attorney had reviewed and approved the applications. Moved by Sande and Johnson to approve the applications. Motion carried. (comm. only)

e) Mortar Board (National Collegiate Honor Society) UND, raffle 04/24/96 (subject to a resolution recognizing this group as a public-spirited organization and filing of by-laws or charter, etc.)
It was noted that the city attorney had reviewed and approved the application subject to resolution, etc. as noted. Moved by Sande and Johnson that we adopt a resolution recognizing the Mortar Board as a public-spirited organization eligible to conduct games of chance, and to approve the permit. Motion carried.

3. Temporary and overtime report for December, 1995.

The committee reviewed the report. Moved by Sande and Johnson to approve the report for December, 1995. Motion carried. (Comm. only)

4. Matter of lease with Acme Electric for car impound site.
The matter of the issues outlined in the communication from the subcommittee and discussed with reps. of Acme Electric, and the subcommittee's recommendations relating to the renewal lease for the City impound site on North Washington Street were considered by the committee.

After some discussion it was moved by Johnson and Sande to
1) instruct city attorney to draft a lease with the following provisions: a) that the lease would expire June 30, 1997, with the understanding that the lease would not be renewable and therefore the City would make a firm commitment to vacate the property by that date; b) that there would be a thirty-day notice in the lease where the City could terminate the arrangement; c) that the lease would be retroactive to December 1, 1995; d) that the monthly lease rate would be $1,000; e) that the City would agree to straighten the fence and gates, trim the trees, spray the weeds, look into the rodent problem, and provide Acme Electric reasonable access to the property for the storage of construction related materials and equipment. Motion carried.

The committee discussed but took no action on the matter of the waste oil facilities at this time. The committee also stated they would urge subcommittee to proceed with all due speed to find another location.

Moved by Sande and Johnson to adjourn; motion carried. Meeting adjourned at 4:10 p.m.
