PROCEEDINGS OF THE CITY COUNCIL
OF THE CITY OF GRAND FORKS, NORTH DAKOTA
Monday, March 31, 1997

The city council of the city of Grand Forks, North Dakota met in special session in the council chambers in the City Hall on Monday, March 31, 1997 at the hour of 12:00 noon with Mayor Owens presiding, pursuant to call by Mayor Owens, which was served on all members on March 28, 1997: Document No. 7275 - Notice.

Present at roll call were Council Members Beach, Ellingson, Hamerlik, Hanson, Carpenter, Sande, Klave, Beyer, Babinchak, Hafner - 10; absent: Council Members Glassheim, Bakken, Hagness - 3.

AWARD CONTRACT FOR SITE PREPARATION FOR
THE EVENTS CENTER, CATEGORY 3, BID PACKAGE 2

The Events Center Core Committee reported having considered the matter of award of contract for Category 3, site preparation, of Bid Package 2, and recommended the award of contract for Category 3 of Bid Package 2, to Gowan Construction for $718,752.00.

It was moved by Council Member Beach and seconded by Council Member Hamerlik that this recommendation be and is hereby approved. Upon roll call the following voted "aye": Council Members Beach, Ellingson, Hamerlik, Hanson, Carpenter, Sande, Klave, Beyer, Babinchak, Hafner - 10; voting "nay": none. Mayor Owens declared the motion carried and the contract awarded.

AWARD CONTRACT FOR CATEGORY 7, BID PACKAGE
2, PILE FOUNDATIONS

The Events Center Core Committee reported having considered the matter of bid submitted by Lakeview Contractors and recommended that the bid submitted by Lakeview Contractors be rejected.

The Events Center Core Committee reported having considered the matter of award of contract for Category 7, deep foundation piles) of Bid Package 2, and recommended that contract for Category 7, Bid Package 2, be awarded to Swingen Construction for $2,020,300.00.

It was moved by Council Member Babinchak and seconded by Council Member Hafner that these recommendations be and are hereby approved.

COUNCIL MEMBER POLOVITZ REPORTED PRESENT

It was noted that the reason for rejection of the bid was that when the bid package was opened there were two envelopes included with the bid but they were not designated as bid bond/contractor's license and bid, so did not know which envelope to open, and therefore, bid not opened.

Upon call for the question on the motion to reject the bid of Lakeview Contractors and upon voice vote, the motion carried 11 votes affirmative.

Upon call for the question on the motion to award the contract to Swingen Construction, and upon roll call vote, the following voted "aye": Council Members Beach, Polovitz, Ellingson, Hamerlik, Hanson, Carpenter, Sande, Klave, Beyer, Babinchak, Hafner - 11; voting "nay": none. Mayor Owens declared the motion carried and the contract awarded.

APPROVE PLANS AND SPECIFICATIONS FOR
BID PACKAGE 3

The Events Center Core Committee reported having considered plans and specifications for Bid Package 3, steel framing and concrete foundations, and recommended that Bid Package 3, plans and specifications and authorization to advertise for bids be approved.

It was moved by Council member Beach and seconded by Council Member Carpenter that this recommendation be and is hereby approved. Carried 11 votes affirmative.

ADJOURN

It was moved by Council Member Hamerlik and seconded by Council Member Beyer that we do now adjourn. Carried 11 votes affirmative.
