Tuesday, April 28, 1998 - 7:00 p.m.

1. Request from Bethel Lutheran Brethren Church for refund of
temporary restaurant license (April 17, 18 and 19, 1998)
Moved by Glassheim and Sande to approve the request for refund. Motion carried. (Comm. only)
2. Application by LaCampana for special/limited alcoholic beverage license at designated premises for Chamber's
Business After Hours event at Eagles Arena on May 5.
Moved by Glassheim and Sande to approve the request. Motion carried. (Comm. only)
13. Request to block parking lane on N. 4th Street adj. to
corporate center construction site.
John Eickhof, Construction Engineers, reported they have general contract for 402 DeMers corporate center foundation work and need parking lane closed to allow space for crane and maneuvering of the equipment (to close N. 4th Street from DeMers Avenue to parking ramp), work to be completed by mid-June. Mr. Eickhof stated they would comply with safety requirements in Uniform Traffic Code for signage, has talked to John Thompson, traffic engineer. Capt. MacCarthy reported no problem with this. Moved by Glassheim and Sande to approve request from Construction Engineers to close parking lane on North 4th Street by 402 DeMers Avenue until June 30. Motion carried.

3. Request from contractors to hold block party on Franklin
Avenue between 3rd and 4th Streets on May 1.
It was noted that this is request from contractors after year's work on the water plant. (Hours from 12:00 to 6:00 p.m.) Capt. MacCarthy reported no problem with this. Moved by Beyer and Glassheim to approve the request. Motion carried.

4.
Matter of bids for painting fire truck.
Chief Aulich reported they had received one bid which was a fair bid, and asked that bid of Red Power International, Inc. in the amount of $9,300, with alternate to prep, prime and paint interior of cab in the amount of $950, and change order to prep, prime, paint white portion of upper cab exterior (change out mirrors and spotlights, and repair crack) in the amount of $450, with complete paint job, will take funding out of carryover. Moved by Beyer and Glassheim to accept the bid of Red Power International, Inc. in the amounts of $9,300 for base bid, $950 for alternate, and $450 for change order, for a total bid of $10,700.00. Motion carried.
5. Request re. possibility of fine for people driving across
grass, public or private, including medians.
It was reported that this is covered by Code Sections 17-0204 and 8-1202 and fine is subject to court's discretion. Capt.

MacCarthy reported that this Code section covers a number of things, incl. sidewalks, dikes, levees, parks, cemeteries, etc. Moved by Glassheim and Beyer to receive and file. Motion carried.

Budget amendment.
a) Police Department $7,245.00
Overtime wages paid by federal grant for security patrol in flood damaged neighborhoods. Moved by Glassheim and Beyer to approve budget amendment. Motion carried.

Don Shields reviewed budget amendments.
a) Health Department - $12,322
Projected revenue into salaries, Mosquito Control funds.
b) Health Department - $1,000
Unanticipated Families First Revenue to cover expenditures for client/customer seating.
c) Health Department - $11,009
Transfer 1997 Cash carryover into current budget to cover expenditures.
Moved by Beyer and Glassheim to approve budget amendments. Motion carried.
7.
Application for gaming permits:
a) Northern Outlaw Sprint Assn. - raffle 06/12/98.
The application had been reviewed and approved by the city attorney, contingent upon adoption of resolution recognizing group as public spirited if appropriate. Moved by Beyer and Glassheim to adopt resolution recognizing this group as a public spirited organization eligible to conduct games of chance. Motion carried.
Moved by Beyer and Glassheim to approve the application for gaming (raffle). Motion carried. (Comm. only)
8.
Matter of request for parade route for May 17, 1998.
Kevin Dean, Info Center, reported this is request for approval of parade route on May 17 that will be part of the Celebration of Thanks taking place that day behind Chamber of Commerce, and have come up with parade they are going to do to thank all of the people involved in helping with flood fight and flood recovery and are in the process of advertising for that and letting people know how they can be a part of that parade. He stated they have the local Jaycees working with them and have been in contact with Capt. Kjelstrom, and have provided the police department with a copy of the route, that they will start the parade at 1:30 p.m. at the corner of 4th and Kittson, proceed north on 4th Street for two blocks, turn toward the river for one block on 1st Avenue North, left on 3rd Street to 5th or 6th Aves. N. Moved by Glassheim and Beyer to approve parade route for May 17 at 1:30 p.m. Motion carried.

It was noted block party will be from 3:00 to 9:00 p.m. on May 3. Capt. MacCarthy stated they have no problem with that. Moved by Beyer and Glassheim to approve the request. Motion carried. (comm. only)
10.
Matter of telephone system for police department.
Sgt. Kirby presented tabulation of bids; that bids were sent out January 19 and bids opened on March 23, and of the 5 or 6 vendors that they sent bids to only 3 returned and only two in format requested and gave information requested: one from Diver-sified Communications and from US West. He reported that the bid from US West with performance bond was $90,060.54 and overall bid for Diversified was $79,250, and without performance bond was $76,750. He reported that when they reviewed bids re. length of time for maintenance or outage of one sort or another: major out-age US West 2 hours and Diversified stated less than an hour and US West coming out of Fargo; with major outage during non-business hours US West within 4 hours and Diversified 90 minutes; minor outages US West 24 hour or next scheduled day, and Diver-sified less than an hour or 90 minutes; labor rates for work done after warranties everything pretty much same, except US West wanted $45/trip fee. He asked for request to approve bid from Diversified Communications and decision in staff was to accept bid without the performance bond, that they were comfortable with the bid and company, and received strong recommendation from Mr. Shields.
Moved by Beyer and Glassheim to accept the bid of Diversified Communications in the amount of $76,750.
Mr. Shields reported that Diversified Communications is vendor that has maintained their system for as long as he's been there and have maintained with tremendously fast response time at reasonable cost, very reliable if have difficulties. It was noted that this system is for the entire police building except Emg. Mgmt. and PSAP; will cover police, municipal court, health department and Highway Patrol. Sgt. Kirby reported that the PSAP system will be compatible with this system.
Upon call for the question the motion carried.

These four aps. have not been reviewed by the city attorney. Moved by Beyer and Glassheim to approve the applications contin-gent upon review and approval by the city attorney. Motion carried. (comm. only)
14. Request from Fraternal Order of Police for abandoned bikes
for repair and to give to deserving youth.
Chairman Sande reported that the FOP is asking that City donate around 50 bikes from those bikes up for auction for FOP to recondition and to give to deserving youth. Officer Kvadas reported they are a newly formed chapter of the Fraternal Order of Police and plan to get involved with community spirit type events, things they can do to help out community; one of the things that has been big throughout the country has been reconditioning of impounded bikes, rather than selling at auction, to give to deserving youth, that they would spend their own money to repair bikes and get referrals from Park Board, teachers of kids to award bikes to. He reported that they have about 94-95 bikes in the pound and would like to take about 50.
Chairman Sande reported that these are abandoned property under the Century Code and can do whatever they want to do, that this matter came to the finance committee and they want public safety's recommendation on this; that she spoke to the evidence and property technician and she stated that the list of property to be auctioned has to go to the Herald by 1:00 p.m. on Wednes-day, and FOP have several hours to pick out bikes they want; that most bikes sell for $10-15 except for mountain bikes, which go for $40-50 and finance committee interested in making sure auc-tion got as much money as possible, that they would be happy to give cheap bikes but not mountain bikes.
Officer Kvadas reported that lot of people go to auction to buy these bikes, fix up and sell, and will cut into them a little, but looking at kids who get their bikes stolen and wouldn't have financial resources to replace, and would easily be able to do the 50 bikes. Chairman Sande reported that this year they have 94 bikes but normally have 200-250 bikes.
Moved by Beyer and Glassheim that we allow the Fraternal Order of Police to take up to 50 bicycles except mountain bikes in good condition.
Chairman Sande reported that finance will meet on Monday but FOP can pick out their bikes so deleted from the publication list, and if finance committee doesn't okay, can still hold onto those bikes. Upon call for the question, the motion carried.
15. Application from Westward Ho Entertainment Complex for
special alcoholic beverage license May 17 at Empire Theatre.
It was noted that event is concert at the Empire Theatre, and

alcoholic beverages for bar service in lobby area (beverages only consumed in lobby). Moved by Beyer and Glassheim to approve application, contingent upon review of the city attorney. Motion carried.
16. Request from UND Indian Association for refund of temporary
restaurant license ($65.00) April 17-19.
Moved by Glassheim and Beyer to approve request for the refund. Motion carried. (comm. only)
17.
Information.
Chairman Sande reported the following items:
a) matter of Price-King will come up in two weeks.
b) finance committee suggested possibility of holding two police auctions each year so police impound wouldn't need as much space for storage of abandoned property (evidence technician would only like one auction each year since takes 6 hrs/day starting January 1 to do one). Glassheim suggested moving impound site out of residential neighborhood; police department working on proposed place; finance suggested public works building but street department doesn't want it there.
Moved by Beyer and Glassheim to adjourn; meeting adjourned at 7:40 p.m.
