MINUTES/URBAN DEVELOPMENT COMMITTEE
Monday, January 19, 1999 - 7:00 p.m.

Members present: Beyer, Polovitz.

1. Matter of Bid Package #7 for Corporate Center.
Dan Mehls, Mortenson’s, reported they took bids on Package #7, Category 20, for tenant improvements and due to bid error rebid last Friday on the project at 2:00 p.m., low bidder Sherlock Construction, and attempted to conduct interviews with low bidders, Construction Engineers and Sherlock Construction, and in discussions Sherlock Construction had stated they can’t meet the schedule that’s outlined and because of past performance on other jobs not meeting schedule deadlines and based on past experience cannot recommend to Sherlock Const.
Second low bid Construction Engineers, local firm with lot of experience, contractor for Phoenix Elementary School and made schedules, that Mortenson’s met with Curt Eickhoff of Construction Engineers, and stated would meet schedule; they have project mgr. and aware of ability to perform.

Bids were presented to the committee members.

Dan Mehls, Mortenson’s stated have to review past performance and past judgment on ability to do the work.

Mr. Swanson reported that the law in ND creates a presumption that the award of any contract for the public construction is to be awarded to the lowest and most responsible bidder, whether you call it lowest and best, or lowest and most responsible, that is a factual determination for the council to make.

Moved by Polovitz and Beyer that based on comments from low bidder, Sherlock Construction, re. not meeting project schedule and past performance on projects, and not having adequate project management personnel, to award the bid to Construction Engineers in the amount of $2,507,200. Motion carried.
