PROCEEDINGS OF THE CITY COUNCIL
OF THE CITY OF GRAND FORKS, NORTH DAKOTA
July 22, 2002

The city council of the city of Grand Forks, North Dakota met in special session in the council chambers in City Hall on Monday, July 22, 2002 at the hour of 7:00 o’clock p.m. with Mayor Brown presiding. Present at roll call were Council Members Brooks, Hamerlik, Glassheim, Gershman (teleconference), Christensen, Kreun - 6; absent: Council Member Kerian - 1.

Mayor Brown announced that anyone wishing to speak to any item may do so by being recognized prior to a vote being taken on the matter, and that the meeting is being televised.

ADOPT ORDINANCE NO. 3934, ESTABLISH REGULATIONS
GOVERNING THE USE OF A-FRAME SIGNS IN THE CENTRAL
BUSINESS DISTRICT

An ordinance entitled "An ordinance enacting Sections XX-XXX relating to A-Frame signs in the Central Business District", which had been introduced and passed on its first reading on May 20, 2002, with amendments to the ordinance on July 15, 2002, and that the public hearing had been continued until this evening, was presented and read for consideration on second reading and final passage.

Mayor Brown asked for comments on the ordinance.

Council Member Kreun stated that their might be a concern from the ND Department of Transportation on DeMers Avenue and may have to obtain their approval, and could adopt the ordinance pending their approval. Mr. Swanson stated he would suggest that they not tie any contingency to the adoption of the ordinance; insofar as DeMers Avenue is part of the State Highway Plan their regulations would supercede the ordinance, and enter into some confusion as to whether you adopt a contingency on the adoption of an ordinance as it affects all of the streets, and his recommendation is to adopt the ordinance and if the DOT has objections to DeMers, you could address just the DeMers corridor.

Council Member Kreun moved to adopt the ordinance, with the amendments as presented; seconded by Council Member Hamerlik. Upon roll call vote the following voted "aye": Council Members Brooks, Hamerlik, Glassheim, Gershman, Christensen, Kreun - 6; voting "nay": none. Mayor Brown declared the ordinance adopted.

GOVERNING OUTDOOR SEATING IN THE CENTRAL BUSINESS
DISTRICT

An ordinance entitled "An ordinance enacting Section X-XXXX relating to outdoor seating in the
Central Business District", which had been introduced and passed on its first reading on May 20, 2002, with amendments to the ordinance on July 15, 2002, and that the public hearing had been continued until this evening, was presented and read for consideration on second reading and final passage.

Mayor Brown asked for comments on the ordinance. There were no comments.

Council Member Kreun moved to adopt the ordinance, with the amendments as presented; seconded by Council Member Hamerlik. Upon roll call vote the following voted "aye": Council Members Brooks, Hamerlik, Glassheim, Gershman, Christensen, Kreun - 6; voting "nay": none. Mayor Brown declared the ordinance adopted.

ADJOURN

It was moved by Council Member Kreun and seconded by Council Member Hamerlik that we adjourn. Carried 6 votes affirmative.
