COMMITTEE OF THE WHOLE
Monday, June 17, 2002 - 8:10 p.m.
The city council met as the Committee of the Whole on Monday, June 17, 2002 at 8:10 p.m. following the city council meeting in the council chambers in City Hall with Mayor Brown presiding. Present at roll call were Council Member Brooks, Bjerke, Stevens, Hamerlik, Burke, Glassheim, Lunak, Christensen, Klave (teleconference system), Kerian, Kreun, Martinson - 12; absent: Council Member Gershman, Bakken - 2.
Mayor Brown announced that when addressing the committee to please come forward to use the microphone for the record, and advised that the meeting is being televised live and taped for later broadcast.
5.4 Preliminary approval of an ordinance amending the Street and Highway Plan of
Berg's First Addition, Grand Forks County, North Dakota (located in the 7100 block of 32nd Avenue South) and
set a hearing for July 15, 2002.___________________________________________________________

5.6 Preliminary approval of an ordinance amending the Street and Highway Plan of Berg's Second
Addition, Grand Forks County, North Dakota (located west of South 69th Street between 24th
Avenue South and 32nd Avenue South) and set a public hearing for July 15, 2002.____________

5.7 An ordinance to amend Section 18-0411 of the Grand Forks City Code of 1987 relating to non-
conforming uses, and set a hearing for July 15, 2002.____________________________________

Mr. Duquette questioned if the items they are reviewing hadn't been scheduled by council to be discussed by the committee of the whole on June 25. Mayor Brown stated it was his understanding that they could do this tonight and skip the 25th, unless people want to discuss it further - the council agreed to continue discussion tonight.
Mr. Swanson noted that on item 5-7, that they are having partial takes on property primarily acquired for the flood control project, that partial take results in that lot being a non-conforming lot, this ordinance will allow them to continue even though they might technically be non-conforming, will be an exception.
Council Member Glassheim noted that these items will be considered on July 15 and if that will be enough time for the notice; Mr. Swanson stated for the most part will be able to accommodate those, maybe one or two where may not. Mr. Potter stated that items 5.4 through 5.13 are a series of items that come out of the Planning & Zoning Commission and a number of these are labeled first reading so can introduce them and that would give you time to set for public hearings on the 15th of July, that items 5.10, 5.11, 5.12 and 5.13 are fast track plats that do not require hearing notice, only yes or no vote and could do on June 25 or July 1 and would not create a problem if waited until July 1. Council Member Hamerlik suggested considering any item on the June 25 meeting that wouldn't meet requirement dates on July 1.
5.8 Vacation of a 20-foot wide north-south utility easement centered on a lot line common to Lot 2, Block 1, Adams-Dobmeier Subdivision and Lot 1, Block 1, Adams-Dobmeier 3rd Resubdivision, Grand Forks, North Dakota, excluding the southerly and the northerly 10 feet thereof (located south of
University Avenue between North 55th Street and 58th Street)._________________________________

Mr. Swanson stated to answer the question on notice requirements, those items that deal with the first reading of ordinances on amending the zoning map or for amending the regulations contained within the zoning code - 5.6 and 5.7 require a 15 day publication requirement and should have time to make that.

It was moved by Council Member Lunak and seconded by Council Member Martinson that we adjourn. Carried 12 votes affirmative.
