BOARD OF ZONING ADJUSTMENT
April 15, 2010

The Board of Zoning Adjustments held a public hearing in Room A101 of City Hall. A notice was placed in the Grand Forks Herald, as required by City Ordinances.
Chairman Kent Anderson called the meeting to order at 10:35 AM.
Members present were: Del Scholler, Kent Anderson, Lynn Vreeland, Mark Peterson, and Jim Galloway.
Member absent was: Bob Kleve.
It was moved by Lynn Vreeland and seconded by Del Scholler to dispense with the reading of the last meeting’s minutes. Motion passed unanimously.
The following appeals were heard:
1. John Knauf, 621 Cherry St, has made a request for a variance to the accessory building and impervious surface requirements [Sections 18-0305 & 18-0209(7) of the Land Development Code] in order to build a detached garage. Legal Description: Front 85’ of Lots 21 & 22, Block 11, Hole’s Central Addition.
It was moved by Lynn Vreeland and seconded by Jim Galloway to allow only seventeen feet (17’) of setback in front of the overhead door and only three feet (3’) of side yard setback in order to build a detached garage. Motion passed unanimously.
2. Richard Jorde, 905 Oak St, has made a request for a variance to the accessory building and impervious surface requirements [Sections 18-0305 & 18-0209(7) of the Land Development Code] in order to build an addition on to the detached garage. Legal Description: Lots 17 & 18, Block 16, McKelvey’s Addition.
It was moved by Jim Galloway and seconded by Del Scholler to allow one thousand ninety-two (1,092) square feet of accessory building area and up to forty-two percent (42%) of impervious surface area coverage in order to build an addition on to the detached garage. Motion passed unanimously.
3. Steven & Marsha Monroe, 1102 22

Ave S, have made a request for a variance to the accessory building requirements [Section 18-0305 of the Land Development Code] in order to build an addition on to the home. Legal Description: E 58’ of Lot 15 & W 2’ of Lot 16, Block 9, Cox’s Addition.
It was moved by Del Scholler and seconded by Mark Peterson to allow only three feet (3’) of side yard setback to the existing detached garage in order to build an addition on to the home. Motion passed unanimously.
4. Jerry & Diane Sherlock, 407 24

Ave S, have made a request for a variance to the side yard setback and front yard setback requirements [Section 18-0208(8) & (9) of the Land Development Code] in order to build an addition onto to the attached garage. Legal Description: E 69.9’ of Lot 2, Block 1, White Clover Subdivision.
It was moved by Lynn Vreeland and seconded by Del Scholler to allow two feet (2’) of side yard and twenty-six (26’) of front yard setback in order to build an attached garage addition. Motion passed unanimously.
5. Joshua Strege & Chassidy Nelson, 1610 Lewis Blvd, have made a request for a variance to the accessory building requirements [Section 18-0305 of the Land Development Code] in order to build a detached garage. Legal Description: Lot 5, Block 1, Auditor’s Subdivision #34.
Request was withdrawn by property owner.
6. Tony & Linda Anderson, 2097 N 42

St, have made a request for a variance to the landscaping, & parking requirements [Sections 18-0219(1), (4), & (5), of the Land Development Code] in order to build an addition onto the building. Legal Description: Lot 3 & vacated east 30’ of N 43

St, west of adjacent thereto, Block 1, Lemms Acres Subdivision.
It was moved by Del Scholler and seconded by Mark Peterson to hold this item. Motion passed unanimously.
Lynn Vreeland moved for adjournment and was seconded by Del Scholler. Motion passed unanimously.
