BOARD OF APPEALS

The Board of Appeals held a public hearing in Room A101 of City Hall.
The meeting was called to order at 10:05 AM.
Members present were: Ron Apanian, Bob Klave, James Glick, Gene Youngdahl, and George Hastings.
Member absent was: None.
Other attendees included: Randy Lieberg, from JLG, Johnson, Laffen, Galloway Architects; Kathie Johnson, Red River Valley Community Action and Bruce Melin, Building Inspector for the City of Grand Forks.
James Glick moved for to approve the minutes as presented and was seconded by Gene Youngdahl. Motion passed unanimously.
The following appeal was heard:
1. Jeffrey & Nancy Holt, 1129 Chestnut St, has made a request for a variance in order to vary the foundation requirements for a 3-season porch. Legal Description: Lots C & F, Block 2, Lutheran Bible School Addition.
It was moved by James Glick and seconded by Bob Klave to approve the variance as submitted (utilizing the existing foundation under the three season porch) contingent on two conditions; that the property owners get the approved variance at the Board of Adjustment if needed for the front yard setback requirements and secondly that these minutes be recorded at the Register of Deeds on the property within 120 days of today. Motion passed on a vote of 4 in favor and 1 against with Gene Youngdahl voting in the negative.
2. Jeffrey Holt on behalf of Rosella Sebenaler, 320 12

Ave S, has made a request for a variance in order to vary the egress window requirements. Legal Description: Lots D & E, Block 2, Lutheran Bible School Addition.
It was moved by James Glick and seconded by Gene Youngdahl to deny the variance as submitted. The motion passed unanimously.
3. JLG Architects, on behalf at the Alerus Center, City of Grand Forks, 1200 S 42

St, has made a request for a variance in order to vary the exit stair width requirement in order to convert the stairway into an escalator. Legal Description: Lot 12, Block 1, Danks 2

Resubdivision.
It was moved by Bob Klave and seconded by James Glick to approve the variance as submitted (reducing the exiting stair width by 2.3” on the east concourse) contingent on a letter from the Fire Chief for the City of Grand Forks’ be received stating his approval of the variance. Motion passed unanimously.
4. Red River Valley Community Action, on behalf of MDI Limited Partnership (Ryan House), 23 N 3

St, has made a request for a variance in order to vary the fire rated window requirements adjacent to the property line. Legal Description: Lot 1, Block 23, Original Townsite Addition.
It was moved by Bob Klave and seconded by Gene Youngdahl to approve the variance as submitted by one of two methods; construct storm windows from the existing wire glass mesh or use fire shutters on the inside of the windows for a fire rating structure. The windows this variance is for the 5 windows on the second story of the south side of the building. Motion passed unanimously.
James Glick moved for adjournment and was seconded by Bob Klave. Motion passed unanimously.
