MINUTES
Grand Forks Civil Service Commission
October 9, 2008
Chairman Johnson called the Grand Forks Civil Service Commission to order at approximately 3:33PM in City Hall, Council Chambers. Commissioners, Burlog, Johnson, MacGregor and Nies were present.
APPROVAL OF MINUTES
It was moved by Commissioner MacGregor and seconded by Commissioner Burlog to approve the September 11, 2008 regular meeting minutes.
All approved, motion carried.
ELIGIBILITY REGISTERS
Equipment Operator
Due to PW Director Feland’s being out of town, HR Director Hovland relayed his request to cut off the register at his normal 70%. Director Hovland pointed out that this register is used by both the Street Department and the Sanitation department to fill vacancies. Discussion was held. It was moved by Commissioner Burlog and seconded by Commissioner Macgregor to establish the cutoff for the Equipment Operator Eligibility register at 70.5%.

Fleet Maintenance Mechanic (Test cutoff)
Discussion was held. It was moved by Commissioner Nies and seconded by Commissioner Burlog to establish the cutoff for the Fleet Maintenance Mechanic (test cutoff) at 60.0%.
All approved, motion carried.
Informational Item
HR Director Hovland informed the Commissioners that on September 30
th
there was a Notice of Appeal of Disciplinary action by the Mayor filed by Mr. David O’Toole, a police officer. It’s his desire to appeal to the Commission the Mayors disciplinary action, so the Commissions motion today would be to set a hearing date. The City Code states that within 60 days of Notice to the Commission, which would end November 29, 2008, the HR Director would have to schedule a hearing date. Director Hovland stated he spoke with attorney Mr. Ron Fischer, whom the Commission has used in the past, and he said he is available the whole month the November. The employee has requested that the hearing be held after November 18
th
, which is the date of the criminal hearing. The Mayor’s office would like to point out that these are two separate matters, one is administrative and one is criminal. It would be the request of the Mayor’s office that we resolve this sooner than later. Commissioner MacGregor asked, what is the status of the patrol officer now? Director Hovland stated he is currently on suspension. Commissioner MacGregor asked, Would he be on suspension through the criminal trial? Director Hovland replied that he would be on suspension until November 17
th
. Commissioner MacGregor asked if it was discussed with Mr. Fischer whether our (the Commission) action would have an impact one way or the other on the other hearing. Director Hovland responded that he had talked to both attorneys and both agreed that it may or may not have an impact. Commissioner Burlog stated he would rather wait until after the court hearing, because of the fact that we could be cutting his chances and he thought that wouldn’t be right. Commissioner MacGregor stated, the only thing we (the Commission) finds is whether the Mayor has acted outside his scope of authority. We don’t decide the case, just what the Mayor did was within the scope of his responsibility. Director Hovland pointed out, both attorneys did stress that they are separate, one is administrative and one is criminal and shouldn’t be tied together and you can set the date at your discretion. at 9:00 AM. Director Hovland stated in Council Chambers. It was moved by Commissioner Nies and seconded by Commissioner MacGregor to have the hearing on November 20, 2008 at 9:00 AM in the Council Chamber.
All approved, motion carried.
Director Hovland stated he would let the Commissioner know when the file is ready. Commissioner MacGregor recommended that the pages be numbered front to back.
ADJOURNMENT
It was moved by Commissioner MacGregor and seconded by Commissioner Nies to adjourn the October 9, 2008 regular meeting. The meeting was adjourned at approximately 3:48PM.
