BOARD OF ZONING ADJUSTMENT

May 13, 2010

The Board of Zoning Adjustments held a public hearing in Room A101 of City Hall. A notice was placed in the Grand Forks Herald, as required by City Ordinances.

Chairman Kent Anderson called the meeting to order at 10:35 AM.

Members present were: Del Scholler, Kent Anderson, Lynn Vreeland, Mark Peterson, and Jim Galloway.

Member absent was: Bob Kleve.

It was moved by Lynn Vreeland and seconded by Del Scholler to dispense with the reading of the last meeting’s minutes. Motion passed unanimously.


The following appeals were heard:

1. Richard & Sharon Jurgens, 1305 S 9th St, have made a request for a variance to the fencing requirements [Sections 18-0304(5) of the Land Development Code] in order to build a fence. Legal Description: Lot 7, Block 3, Southside Addition.

It was moved by Lynn Vreeland and seconded by Mark Peterson to allow eight feet (8’) height of fence in 36’ of the side yard with the neighboring property in order to install a fence. Motion passed unanimously.


2. Kevin & Nancy Kouba, 3003 Olson Dr, have made a request for a variance to the paving requirements [Sections 18-0302(5) of the Land Development Code] in order to pave to a lot line. Legal Description: Lot 1, Block 3, Flaat’s Addition.

It was moved by Jim Galloway and seconded by Mark Peterson to allow only a half foot (0.5’) of second front yard setback in order to pave a parking spot. Motion passed unanimously.


3. Larry Roth, Minnko Building Systems, on behalf of Countrywide Lenders, LLP, 1525 N 73rd St Circle, has made a request for a variance to the parking requirements [Sections 18-0302(12)(A), of the Land Development Code] in order to build an addition onto the building. Legal Description: Lot 3, Block 1, Vern’s Addition.

It was moved by Mark Peterson and seconded by Lynn Vreeland to allow the additional required paving to be delayed until the adjacent roadway is hard surfaced in order to build an addition onto the building. Motion passed unanimously.


4. Todd & Gina Feland, 1122 Walnut St, have made a request for a variance to the overhead door setback [Sections 18-0305 of the Land Development Code] in order to install overhead door in an existing detached garage. Legal Description: Lot 11 and S 25’ of Lot 10, Block 1, Lincoln Park View 1st Addition.

It was moved by Lynn Vreeland and seconded by Del Scholler to allow the existing detached garage setback on west alley to remain as the setback for the overhead door in order install an overhead door on the west alley. Motion passed unanimously.


Lynn Vreeland was excused from action on the next item.


5. Corey & Peggy Vreeland, 1508 Chestnut St, have made a request for a variance to the impervious surface area requirement [Sections 18-0208(7) of the Land Development Code] in order to build a patio. Legal Description: Lot 1, Block 5, Walchester Place Addition.

It was moved by Jim Galloway and seconded by Del Scholler to allow up to forty-five percent (45%) of impervious surface area coverage in order to build a patio. Motion passed unanimously.


Lynn Vreeland moved for adjournment and was seconded by Del Scholler. Motion passed unanimously.
