CITY OF GRAND FORKS - BOARD OF EQUALIZATION
May 20, 1991

The city council of the city of Grand Forks, North Dakota was called to meet as the Board of Equalization in the city council chambers by Mayor Polovitz on Monday, May 20, 1991 at 7:00 p.m. as required by the North Dakota Century Code. Present were Aldermen Beach, Hoeppner, Kulas, B.Hanson, Glassheim, Crawford, R.Hanson, Lien, Carpenter, Shores, Coe, Hagness - 12; absent: none.

APPROVE MINUTES

Typewritten copies of the minutes of the Board meeting held on Tuesday, April 9, 1991 were presented and read. It was moved by Alderman B.Hanson and seconded by Alderman Kulas that the minutes be approved as read. Carried 12 votes affirmative.

ALDERMAN K.POLOVITZ REPORTED PRESENT

REDUCE VALUE ON PROPERTY AT 2655 NORTH
42ND STREET, LEROY AND LILLIAN DEGAGNE

The finance committee of the city council reported having considered the protest by Leroy and Lillian Degagne on valuation of Lots 1 and 2, Block 1, Oscarville 2nd Subdivision, 2637 and 2655 North 42nd Street, and recommended that we allow a 50% economic obsolescence on the property at 2655 North 42nd Street, thus reducing the value from $22,400 to $19,600.

It was moved by Alderman Shores and seconded by Alderman Kulas that this recommendation be and is hereby approved. Carried 13 votes affirmative.

REDUCE VALUE OF PROPERTY AT 2595 NORTH 42ND
STREET, EDWARD AND KATHRYN RICHTER

The finance committee of the city council reported having considered the protest by Edward and Kathryn Richter on valuation of property, Lot 14, Block 1, Oscarville Subdivision, 2595 North 42nd Street, and recommended that 50% depreciation be allowed for economic obsolescence and the market value be reduced from $28,300 to $25,600.

It was moved by Alderman Kulas and seconded by Alderman Shores that this recommendation be and is hereby approved. Carried 13 votes affirmative.

ALDERMAN JOHNSON REPORTED PRESENT

REDUCE VALUE OF PROPERTY AT 2677 NORTH 42ND STREET,
CLARENCE AND HATTIE BOMMER

The finance committee of the city council reported having considered the protest by Clarence and Hattie Bommer on valuation of property at 2677 North 42nd Street, and three lots located on North 43rd Street, and recommended to reduce value on building by $2,700.00 which is a 50% economic obsolescence.

It was moved by Alderman Shores and seconded by Alderman Kulas that this recommendation be and is hereby approved. Carried 14 votes affirmative.

REDUCE VALUE ON PROPERTY AT 215 CLEO COURT

The finance committee of the city council reported having considered the matter of protest by Clinton and Thelma Johnson on valuation of property, Lot 8, Block 1, Brown's Addition, 215 Cleo Court, and recommended that we accept the assessor's recommendation, and reduce market value from $20,000 to $15,800.

It was moved by Alderman Kulas and seconded by Alderman Shores that this recommendation be and is hereby approved. Carried 14 votes affirmative.

DENY PROTEST ON VALUATION OF PROPERTY AT 289
GRASSY HILLS LANE

The finance committee of the city council reported having considered the matter of the protest by Gary Gibson on valuation of property, Lot 3, Block V, Sun-Beam Addition, 289 Grassy Hills Lane, and recommended that based on sales analysis presented by the assessor's office, and unless further evidence is provided to the committee, that the protest be denied.

It was moved by Alderman Shores and seconded by Alderman Johnson that this recommendation be and is hereby approved. Carried 14 votes affirmative.

REDUCE VALUATION OF PROPERTY LOCATED AT 1224
24TH AVENUE SOUTH, ABAR INDUSTRIES, INC.

The finance committee of the city council reported having considered the protest by James Abar, Abar Industries, Inc., on valuation of property at 1224 24th Avenue South, Lot B of the Replat of Lots 14 and 15, Block 4, Cox's Addition, and recommended that we lower valuation from $165,800 to $150,800 because of possible contamination problem that could hinder sale of the property.

It was moved by Alderman Johnson and seconded by Alderman Shores that this recommendation be and is hereby approved. Carried 14 votes affirmative.

DENY PROTEST ON PROPERTY AT 4618 BELMONT ROAD

The finance committee of the city council reported having considered the protest by William and Ruth Nelson on valuation of property, Lot 13, Block 1, Sunbeam 3rd Addition, 4618 Belmont Road, and recommended to deny protest.

It was moved by Alderman Shores and seconded by Alderman Johnson that this recommendation be and is hereby approved. Carried 14 votes affirmative.

DENY PROTEST ON VALUATION OF PROPERTY AT 1418
7TH AVENUE NORTH

The finance committee of the city council reported having considered the protest by Mortgage Commitments, Inc. on valuation of property, Lots 17 and 18, Block 61, Alexander and Ives' Addition, 1418 7th Avenue North, and recommended that we deny protest.

It was moved by Alderman Johnson and seconded by Alderman Shores that this recommendation be and is hereby approved. Carried 14 votes affirmative.

REDUCE VALUATION ON PROPERTY AT 1708 NORTH 4TH
STREET

The finance committee of the city council reported having considered the protest by Mortgage Commitments, Inc. on valuation of property: Lot 6, Block 1, Skidmore Addition, 1708 North 4th Street, assessed valuation $59,000; and recommended that the valuation on the property be reduced as follows: land, $12,000 and improvements, $37,500, for a total of $49,500.

It was moved by Alderman Shores and seconded by Alderman Johnson that this recommendation be and is hereby approved. Carried 14 votes affirmative.

PROTEST BY JOHN COWGER WITHDRAWN

The city auditor reported that the protest filed by John Cowger on the valuation of property on Lot 3, Block 14, Lindsay's Addition, adjacent to 121
8th Avenue South, had been withdrawn by Mr. Cowger.

RECEIVE AND FILE COMMUNICATION WITHDRAWING PROTEST
ON VALUATION OF PROPERTY - TOWNHOUSE MOTEL

The finance committee of the city council reported having considered the matter of the protest by Kamps & Craven Properties Partnership on Townhouse Motel on Lot 2, Block 2, Renewal Resubdivision No. 5, and recommended that we accept the assessor's valuation, and receive and file the communication withdrawing the protest.

It was moved by Alderman Beach and seconded by Alderman Shores that this recommendation be and is hereby approved. Carried 14 votes affirmative.

REDUCE VALUATION OF PROPERTY AT 123 NORTH 3RD STREET

The finance committee of the city council reported having considered the matte of protest by Rodney Folkers on valuation of property at 123 North 3rd Street, Lots 1 and 3, Block 18, Original Townsite, and recommended that we accept the assessor's recommendation to reduce the market value to $67,600.

It was moved by Alderman Shores and seconded by Alderman Kulas that this recommendation be and is hereby approved.

Alderman Beach asked that he be excused from voting on this matter, because of conflict of interest. It was moved by Alderman Hoeppner and seconded by Alderman Glassheim that Alderman Beach be excused from voting on this ques-tion. Carried 13 votes affirmative.

Upon call for the question and upon voice vote, the motion carried 13 votes affirmative; Alderman Beach excused from voting.

REDUCE VALUATION OF PROPERTY AT 2701 SOUTH
26TH STREET AND 2700 SOUTH 25TH STREET

The finance committee of the city council reported having considered the matter of protest by First Federal Banking and Savings, Bemidji, MN on Lots B and C (Replat of Lot 2, Block 7, BFM Addition, 2701 South 26th Street and 2700 South 25th Street, and recommended that we accept the assessor's recommenda-tion to reduce valuation on those properties from $560,200 to $519,100 on Lot B, and from $559,300 to $518,500 on Lot C.

It was moved by Alderman Shores and seconded by Alderman Kulas that this recommendation be and is hereby approved.

It was moved by Alderman Shores and seconded by Alderman Johnson that this recommendation be and is hereby approved.

Alderman Beach asked that he be excused from voting on this matter, because of conflict of interest. It was moved by Alderman Hoeppner and seconded by Alderman Glassheim that Alderman Beach be excused from voting on this ques-tion. Carried 13 votes affirmative.

Upon call for the question and upon voice vote, the motion carried 13 votes affirmative; Alderman Beach excused from voting.

REDUCE VALUATION ON PROPERTY AT 311 SOUTH
4TH STREET, U.S. POSTAL SERVICE

The finance committee of the city council reported having considered the

matter of the protest by the U.S. Postal Service on Lots 5, 6, 7, 8, 9, 10, 11 and 12, Block 2, Viet's Addition, 311 South 4th Street, and recommended that we establish a valuation of $650,000.

It was moved by Alderman Shores and seconded by Alderman Kulas that this recommendation be and is hereby approved.

Ed L. Bavouset, Real Estate Specialist for the U.S. Postal Service, Denver, and Peter R. Sorrentio, Real Estate Tax Specialist, Chicago, presented additional information relative to comparable properties, that in addition there is asbestos and radon problem in the basement of that facility (and that according to the postmaster they cannot use basement of the building); that property currently non-conforming use within the zoning district; that they believe that $589,000 is a fair and reasonable valuation, and would ask for consider-ation of their request. They also reported that they have option to purchase building for $550,000.

Mel Carsen, city assessor, reviewed method of assessment and figures with council. He stated that he had taken into consideration asbestos in the building on limited basis.

It was moved by Johnson to amend motion and to use assessor's appraisal value of $852,300; the motion was seconded by Alderman Beach. After further discussion it was moved by Alderman Hagness and seconded by Alderman Kulas that the motion be amended to establish a valuation of $651,-000. Upon voice vote the amendment to the motion carried; and upon call for the question on the motion, as amended, and upon voice vote, the motion carried.

ALDERMAN B.HANSON EXCUSED

REDUCE VALUATION OF PROPERTY AT 2598 NORTH
43RD STREET

The city assessor reported that the property at 2598 North 43rd Street, (Lot 15, Block 1, Oscarville Subdivision), Clifford Urness, was appraised at $14,400 with a 40% economic obsolescence, that other properties in the area were given increase in percentage of economic obsolescence and this property should receive that increase as well (from 40 to 50% economic obsolescence), and that would reduce valuation of property to $12,000.

It was moved by Alderman Shores and seconded by Alderman Kulas that this recommendation be and is hereby approved. Carried 13 votes affirmative.

ALDERMAN B.HANSON REPORTED BACK

CERTIFY ASSESSMENTS TO COUNTY AUDITOR

It was moved by Alderman Kulas and seconded by Alderman Lien that the tax rolls as presented by the city assessor and as equalized by the Board of Equalization be and are hereby certified to the county auditor, Grand Forks County, North Dakota. Upon roll call the following voted "aye": Aldermen Beach, K.Polo-vitz, Hoeppner, Kulas, B.Hanson, Glassheim, Crawford, R.Hanson, Lien, Carpenter, Shores, Coe, Johnson, Hagness - 14; voting "nay": none. Mayor Polovitz declared the motion carried and the assessments certified.

ADJOURN

It was moved by Alderman B.Hanson and seconded by Alderman R.Hanson that we do now adjourn sine die. Carried 14 votes affirmative.
