MINUTES/PUBLIC SAFETY COMMITTEE
Monday, May 9, 1994 - 3:45 p.m.

Members present: Crawford, Hoeppner.

1. Request by YMCA Family Center to hold Firecracker Half
Marathon and 8-K Run on July 3, 1994.
Joel Arnason presented request and reviewed routes; they will have volunteers to man intersections. He submitted signed copy of indemnity and hold harmless agreement. Chief Paschke stated they have no problems with request, but asked that they coordinate through his office. Moved by Hoeppner and Crawford to approve request subject to coordinating events with the police department. Motion carried.

2. Request by YMCA Family Center to hold community special
events during summer of 1994:
a) YMCA Biathlon - May 21
b) YMCA Triathlon - July 30
c) YMCA Family Fun Run - September 3
The committee had questions re. routes, etc. and as there were no reps. of the Y-Family Center present, the matter was held until Monday, May 16 at 7:15 p.m.

3. Request by The Ski and Bike Shop, 121 DeMers Avenue, to hold
promotion and set up food stand on sidewalk on May 12 and 13.
Terry Knutson, The Ski and Bike Shop, stated they are bringing in Oof-Da Taco stand on street in front of their store, that stand is 8'x16', could put on side street. Wally Helland, health department, stated that Oof-Da Taco has been licensed for several years, and they have no problem with request. Chief Paschke stated his department would have no problem if they cone the area, and that The Ski and Bike Shop could make arrangements with street department for barriers. Moved by Crawford and Hoeppner that the request be approved. Motion carried. (comm. only)

4. Matter of corporate changes in alcoholic beverage license
held on Chi-Chi's.
It was noted that the city attorney has reviewed and approved the changes; and that the application is being processed by the police department. Moved by Hoeppner and Crawford to approve the changes, subject to review and approval by the police department. Motion carried.

5. Matter of budget amendment for health department.
The committee reviewed request from the health department for budget amendment in the amount of $746.00 for purchase of shelving/storage units and painting services. Moved by Crawford and Hoeppner that the request for budget amendment be approved, and an ordinance to amend annual appropriations bill ordinance for 1994 be introduced for first reading. Motion carried.

6. Applications for gaming permits:

a) ND Assn. for the Disabled, Inc. (site authorizations)
b) United Hospital Health Unit Coordinators - raffle.
Applications had been reviewed and approved by the city attorney. Moved by Hoeppner and Crawford to approve the applications. Motion carried. (committee only)

7. Matter of moving environmental health to City Hall. Mayor Polovitz reported he had visited with the chairmen of the various committees re. health department and discussed possibility of bringing environmental inspectors to City Hall to provide additional space for the health department; that he visited with the Board of Health (there was no recommendation from the Board). He also noted that they have looked at various sites for the health department; and opened the matter for discussion.

Chairman Crawford reported she had talked with Dr. Brosseau, who recommended compromise, his comments were that in favor of the move except that administration shouldn't be severed before getting new director in health department. She stated that public health department more involved because of health care reform; don't have funds for a building; but this is first step in process.

Mayor Polovitz reported there are funds left in City Hall project fund to finish and furnish office space for health inspectors in space on second floor of new City Hall building. He also noted that there is room in City Hall for water utility records presently being stored in the police building, which would open storage space for the health department. He reported there would be no change in operation with the County.

Pam Engel, health department, stated there is 1) space problem and 2) environmental health going under Inspection Dept.; that they have supported need for more space but don't want to make move for environmental health until have new administration. She questioned who would do clerical work for environmental health, and Mayor Polovitz reported that will be absorbed by the engineering department, that they have one position that isn't filled. Mr. Grasser advised that position is under public works division, and wouldn't be utilized for this. Mayor Polovitz stated they could include part-time clerical. Mr. Helland stated that health department clerical est. 10% of work related to environmental health. Mayor Polovitz also stated it was his intent to let Board of Health make final recommendation. Keith Berger, county commissioner, suggested waiting until the new director gets on board to look at whole situation; that they need communication between department and Board, and to work out details re. clerical matters, etc. Mr. Hoeppner questioned who will environmental health report to, and that these things have to be worked out. Chairman Crawford stated she felt major issue

was who would environmental health inspectors report to. Mr. Berger stated that if director appointed by July, this would be before budgets done in September, and could be worked out. It was also noted that the personnel office recommended holding this matter.

Moved by Hoeppner and Crawford to receive and file. Motion carried.

It was also noted that perhaps fire inspectors should be under inspection department, and the matter looked at.
