MINUTES/PUBLIC SAFETY COMMITTEE
Monday, July 11, 1994 - 3:45 p.m.

Members present: Hoeppner, Johnson, Sande.

1. Request from DAV Auxiliary #2 for permission to sell "forget-
me-not" posters and flowers on August 22 to September 24.
Moved by Sande and Johnson that we grant the request. Motion carried.

2. Request to hold 10th annual "Run the Red" 10K race and wheel-
athon on September 11.
Karen Johnson, NDAD, stated that race has same course as last year, submitted map showing route and they will coordinate with the police department. Moved by Johnson and Sande that we approve request, subject to coordinating event with the police department. Motion carried.

3. Reconsideration of action allowing parking on west side of N.
25th Street from University Avenue to 6th Avenue North during
Summerthing events in University Park.
Maynard Hanson,, 411 N. 25th Street, stated that with parking on both sides of street makes traffic hazard, not enough room for emergency vehicles; that there is parking available at vacant UND parking lot, tennis court and around park. Pat Norman and Kim Kuchar, Park Board, stated that parking not available at tennis court, that these events only two weekends out of the year, and people will be parking there anyway. After further discussion it was moved by Johnson and seconded by Sande that we reconsider council action of June 20, 1994, and that we not allow parking on both sides of the street because of safety hazard, emergency vehicles, and with large parking lot available for parking. Motion carried.

4. Application by 1st Class Limo Service for taxi license.
Kraig Kuhl, RR 2, stated he needs to be able to provide taxi service from airport, have ability to pick up passengers to bring to airport from motels and UND but not from their residences, that they have established rate of $6.50 per person, want ability to pick up passengers anywhere in city and take to airport, want to provide complete service. He stated they have handicapped bus and 3 limos. and have contract service (have contract with airlines to delivery baggage, etc.). Mr. Swanson stated that under Code to pick up passengers at their residences prohibited.

Moved by Johnson that we grant taxi license, subject to final approval by the police department; Sande seconded the motion.

Georgene Emard asked whether they would be in competition with dial-a-ride. Mr. Kuhl stated he doesn't intend to compete with them; but that is an area he would explore.

Chuck Orange, 1701 University Avenue, stated reason for concern

was that there are two others providing service who are subsidized, and whether they were now looking at subsidizing three. Mr. Swanson stated that service based on contracts, and Mr. Kuhl not asking to provide service. He also noted that our Code does allow fixed fee rate.

Upon call for the question, the motion carried.

5. Application by Domestic Violence Program of Walsh County for
site authorization to conduct gaming.
Pam Novak, rep. of Domestic Violence Program of Walsh Co., stated they are planning to put pulltab machine at Broken Drum, 1503 N. Washington Street; funds for battered women's shelter. It was noted they have not been authorized previously to operate in Grand Forks. Moved by Johnson and Sande to adopt resolution recognizing this organization as a public-spirited organization eligible to conduct games of chance, and to approve the application. Motion carried.

6. Lease agreement with ND State Health Dept. to provide office
space for Division of Disease Control.
Debbie Swanson, health Department, presented lease agreement to provide office space for the Division of Disease Control, that they work closely with the Health Department; that this is not new lease agreement and Health Department has been providing space. Moved by Sande and Johnson that we approve lease agreement. Motion carried.

7. Matter of contract with ND State Health Dept. for MCH Block
Grant.
Mrs. Swanson presented contract for Maternal Child Health block grant, federal funds passed through State Health Department for recipients in Grand Forks; that grant allocation increased this year ($86,345.00). Moved by Sande and Johnson to approve contract for grant. Motion carried.

8. Matter of removal of underground fuel storage tank at police
building.
Capt. Brown reported that when they moved into police building in 1977 had alternate source of heating, fuel oil and natural gas, which they have discontinued, and have 10,000 steel fuel tank buried under concrete in parking lot, that they received letter early in June from Fire Marshall Allard that Fire Code prohibits abandoned fuel storage tanks and tank must be removed; monies available from Public Buildings Fund. He reported that Capt. Waith had contacted several local contractors for removal of the tank and only one responded, that Valley Electric & Petroleum Equipment submitted bid of $11,927, plus additional cost for cleanup should soil be contaminated. Mr. Swanson advised committee that our Code requires removal of tanks no longer in service. Moved by Hoeppner and Sande that we accept MINUTES/PUBLIC SAFETY COMMITTEE

the low bid of Valley Electric & Petroleum Equipment in the amount of $11,927.00 plus additional costs for cleanup if soil contaminated.

Mr. Swanson also noted that they have ability to neutralize tank to make inert, but removal better choice.

Motion carried.

9. Matter of budget amendments.
a) Fire Department, $14,844.95, use of 1993 cash carryover. Moved by Hoeppner and Johnson to approve budget amendment, and to introduce ordinance for first reading. Motion carried.

b) Police Department, $1,500, to amend budget to reflect Highway Safety Grant. Moved by Hoeppner and Johnson to approve budget amendment, and to introduce ordinance for first reading.
Motion carried.

10. Temporary and overtime statement for May, 1994.
Moved by Johnson and Sande that the statement be approved. Motion carried. (comm. only)

11. Applications for gaming permits:
a) Pi Kappa Alpha Fraternity - raffle on November 21.
The application had been reviewed and approved by the city attorney subject to applicant filing letter showing group in "good standing" at UND. Moved by Sande and Johnson that the application be approved contingent upon filing of the letter. Motion carried. (committee only)

12. Matter of contracts with ND State Health Department:
a) HIV Counseling/Testing Site
b) Ryan White C.A.R.E. Services
c) Occupational Health Nurse Program.
Mrs. Swanson reviewed contracts with the committee stating that the Ryan White Care Service provides funding to individuals who need assistance; that Occupational Health Nurse Program is agricultural position in its fifth year, that nurse serves rural areas with Health Department providing administration. Moved by Sande and Johnson that these contracts be approved. Motion carried.

13. Matter of truck traffic on University and 17th Street.
Chuck Orange, 1701 University Avenue, stated they have problem with truck traffic coming from industrial area on Dyke Avenue onto 17th Street, turning west on University Avenue to Columbia Road; that 17th Street starting to break up; and asked for signs on this three block stretch. There was some discussion as to enforcement, whether they could cite company, and Mr. Swanson stated they would have to cite driver. Capt. Brown

reported that officer must view violation to cite driver, or that it could be enforced through citizen's arrest, or go to municipal court and sign complaint.

Moved by Johnson that we install no truck traffic signs on 17th Street from Dyke to University Avenue. Motion carried.

14. Application by Chi-Chi's for change in ownership of license.
Mr. Swanson reported Chi-Chi's went through bankruptcy approx. two years ago, that it appears they are separating into smaller corporations, and are transferring liquor licenses, that City approved on provisional basis. He stated they have completed applications and identified all individual local managers and from his review it appears their request in order to be taken off provisional status and issued permanent license, subject to final review by the police department. Moved by Sande and Johnson that we issue license subject to final review of the police department. Motion carried.
