MINUTES/PUBLIC SAFETY COMMITTEE
Monday, August 26, 1996 - 3:45 p.m.

Members present: Sande, Glassheim.

1. Request to hold block party on Saturday, September 7, and to block Chestnut Street from 17th Ave.S. to 15th Ave.S. from
5:00 p.m. to 9:00 p.m.
Kelly Hodgson, 1515 Chestnut Street, presented request for blocking of Chestnut Street for block party. Capt. Dunn stated they have no objections to the request. It was suggested that the side streets of Walchester Place and Chestnut Place also be blocked, and Capt. Dunn concurred. Capt. Dunn requested that barricades be placed just before event and removed as soon as block party over. Moved by Glassheim and Sande to approve request contingent upon signing an indemnity and hold harmless agreement. Motion carried. (comm. only)

2. Request to hold block party on Saturday, September 28, and to
block Chestnut Street from 10th to 13th Aves.S. and also alley of 12th Ave.S. from 7:00 p.m. to 12:00 midnight. Karen Ford, 1020 Chestnut Street, presented request for blocking of Chestnut Street and for blocking 12th Ave.S. both sides of alley. She stated there will not be any music and probably won't go as long as midnight. Moved by Glassheim and Sande to approve the request, contingent upon signing of an indemnity and hold harmless agreement. Motion carried. (comm. only)

3. Request from 1st Battalion 188th ADA, ND National Guard, to
hold 5K/10K Fun Run/Walk in conjunction with Community Aware-
ness/Family Support Day September 16.
There was no one present to speak to the matter. Capt. Dunn reported that this has been done in the past and police depart- ment has no objections. Moved by Glassheim and Sande to approve request contingent upon signing of an indemnity and hold harmless agreement. Motion carried.

4. Request to hold 1996 American Heart Assn.'s Heart Walk on
September 29.
There was no one present to speak to the matter. It was noted that the run is on the bikepaths and sidewalks, and that an indemnity and hold harmless agreement has been signed. Moved by Glassheim and Sande to approve request. Motion carried.

5. Request from Bonzer's to sponsor 5K foot race on Saturday,
October 19.
Jon Bonzer stated they are sponsoring event, and Y-Family Center will be coordinating the event. Capt. Dunn stated that the police department has no objections. Moved by Glassheim and Sande to approve request. Motion carried.

6. Request by Lambda Chi Alpha Fraternity, 515 Harvard St., for
variance to noise ordinance during Rush Week.

Mr. Glassheim stated he has some concerns re. this request which is over an extended period of time, starting tonight through September 6. The committee noted that this request requires council approval and council does not meet until Tuesday, Sept. 3. Moved by Sande and Glassheim to hold until Tuesday, Sept. 3 until 7:15 p.m.

7. Matter of flashing traffic signals in downtown area.
It was noted that this had been referred by Council Member Polovitz who had concern whether crossing light flashing red or yellow and also that there is more traffic downtown in the evenings and perhaps should be run longer, with flashing cycle after 11:00 p.m. Mr. Glassheim stated he had some concerns - traffic not knowing whether cross streets flashing red or yellow and what driver supposed to do. A report from John Thompson, traffic engineer, was read summarizing how the signals operate at this time, and suggesting several options: run continuously; flashing at later time or having several cycle lengths throughout the day to meet traffic demands. He suggested getting updated traffic counts, and doing a study prior to any final recom- mendations. Held until last meeting in September.

8. Matter of operation of motor vehicle on bikepath.
Chairman Sande reported that Larry Kennedy who submitted request, asked that it be pulled, however, committee felt it should be referred to the Bikeway Committee. Sande and Glassheim moved to refer this matter to the Bikeway Committee. Motion carried. (comm. only).

9. Matter of "slow traffic" signs on 6th Avenue South.
Joni Cepak, 626 6th Avenue, stated there are a lot of children in their neighborhood, that she lives by an alley and traffic travels at high speeds both in the alley and on the street, and would like to have sign put up. She stated she also has problem with people sitting in cars in front of her house smoking and drinking, calls police but cars leave when they see police vehicles. John Thompson, traffic engineer, reported he observed the street for short time one afternoon, that he didn't see anyone speeding. He stated that Ms. Cepak thought speed limit should be lower than 25 mph, that this is narrow street with parking on one side of the street. He stated he wouldn't recommend "slow traffic" signs but would recommend monitoring by the police department. He also noted that there are lot of encroachments in the alley (trees, shrubs, garbage cans, garages, fences, etc.) Capt. Dunn stated he was not aware of any major traffic or flow problems or accidents that they have experienced in the past, but would bring to the attention of the patrol commander. He also stated that they have limited number of personnel and that is not heavily traveled arterial-type area, however, will monitor periodically. He also stated they have on-going traffic safety program, have officers stationed throughout

the city and patrol, etc. He stated they would have to observe the violations before make an arrest. He stated that if people in front of her dwelling drinking and smoking, she observes the violation and if they are still there when police arrive even if they have stopped drinking, she can sign citizen's arrest against those individuals, etc.

Chairman Sande suggested installing 15 mph signs in the alley. Mr. Thompson stated he would like to hear from Ms. Cepak after installation of signs to see if traffic improved.

Moved by Sande and Glassheim to authorize installation of 15 mph signs in the alley, both sides. Motion carried.

10. Petition for four-way stops at each of the four intersections
surrounding Winship Elementary School.
Mr. Thompson's report was read, recommending a two-way stop for North 14th Street at 5th Avenue North and yield signs on North 15th Street at 6th Avenue North. Mr. Thompson reported that he found there was a high number of accidents at 14th and 5th Avenue North which he felt was attributable to cars coming off signalized intersection at Washington, assuming they have through traffic; and a block over some encroachments by the buildings and by fences, trees, etc. He will send out letters to make sure those are addressed. Moved by Glassheim and Sande to authorize a two-way stop for North 14th Street at 5th Avenue North and yield signs on North 15th Street at 6th Avenue North. Motion carried.

11. Budget amendment.
a) Police Department - $40,000
A request was presented to amend budget to reflect grant monies (narcotics investigation). Moved by Glassheim and Sande to approve the budget amendment. Motion carried.

12. Applications for gaming permits:
a) DAV Auxiliary Unit #2 - bingo/raffles 11-7-14-21/96 and
2/12/97.
b) Central Business District Assn. - raffle 11/02/96
c) Development Homes, Inc. - site auth. 1503 N. Wash. (Broken Drum) for year ending 6/30/97.
It was noted that all applications had been reviewed and approved by the city attorney. Moved by Glassheim and Sande to approve the applications for permits. Motion carried. (comm. only)

13. Temporary and overtime report for July, 1996.
The committee reviewed the report. Moved by Glassheim and Sande to approve report as presented. Motion carried. (comm. only)

14. Request from Bible Baptist Christian School for refund of
temporary restaurant license.
Moved by Sande and Glassheim to approve request for refund of temporary license fee for fundraiser held July 30/31 and August 9/10. Motion carried. (comm. only)

15. Request from Kappa Sigma Fraternity, 2510 University Avenue,
for variance to noise ordinance during Rush Week activities on August 26, 1996.
Tim Dudley, 2510 University Avenue, presented request for a one-hour extension for activities this evening. Committee advised Mr. Dudley that this request requires council action and council will not meet until next Tuesday. No action taken.
