MINUTES/PUBLIC SERVICE COMMITTEE
Monday, January 8, 1996 - 7:00 p.m.

Members present: Hagness, Beyer, Klave, Hamerlik.

1. Public hearing on Project BRU-6-986(036)039, Mill Road bridge
replacement, City Project No.4260.
Chairman Hagness opened the public hearing.

Mark Lambrecht introduced several people in the audience: Nick Ludowese, Grand Forks District Office of DOT; Lynn Brilz and Hugh Veit, KBM, Inc.

Mr. Brilz gave brief overview of the project. He stated that the proposed project involves replacing the existing bridge located on Mill Road at the English Coulee crossing; that the existing bridge is in very poor structural condition, has surface cracks in the abutments, concrete spalling in the beam seats, exposed rebar and a number of other things; that the City has indicated to them that in the replacement structure they wanted to accommodate pedestrian traffic, and with that in mind evaluated four separate alternatives, two of those being bridges and two box culverts; that the bridges appeared to be more costly and not as accommodating to future developments; that with box culverts you can put in one type of road section now, and change in the future without changing the structure itself.

Committee Member Klave reported present.

He reported they have received responses from a number of environmental agencies, U.S. Fish & Wildlife Service, State Historical Society, with no negative comments coming back regarding the project, however, are still waiting for comments from Corps of Engineers, have been in telephone contact and they don't feel there is going to be any problem with the project.

He reported they have had comments from the Bikepath Committee, that at this time they are not looking at accommodating a crossing over the bikepath, have been in contact with City staff re. this, and future development could allow for that.

Mr. Brilz reported there will be some right of way acquisition necessary on the east and west sides of Mill Road, that they are in process of looking at and preparing right of way plat.

He reported that the project is scheduled for a May 17 bid letting, and construction would begin this summer; that during construction traffic will be detoured on U.S. Highway 81, with road open to local traffic.

Committee Member Beyer reported present.

Mr. Brilz reported that comments from this hearing and comments from the North Dakota Department of Transportation will be

incorporated into a final project concept report which they will be presenting to the committee later this month.

Mr. Lambrecht, city project engineer, submitted estimated project cost, indicating federal and local share for preliminary engineering, right of way, utility relocation, construction, construction engineering and construction contingencies: total cost $341,000. and local share $109,800. He reported that federal funding applies to construction and construction engineering, 80%, or $231,200; and that preliminary engineering, right of way and utility relocation are entirely City expense, $109,800. He reported that they will be approaching the County Highway Department and the County Water Resource District to see if they will consider participating (they participated in cost of project on South 42nd Street and 17th Avenue South); that if they participated at same rate they would each contribute $16,000 to the project, leaving local City share at $78,000; however, not sure if they will participate as bridge is within the city limits (property west and north of bridge outside city limits); but have had good cooperation with County.

Mr. Lambrecht reported that after tonight's public hearing, there is a ten-day comment period for receiving written comments which will be part of the transcript of this hearing, and will address all of the comments. He reported that at the next meeting the final project concept report will be presented for their approval and proceeding with the project.

Mr. Lambrecht stated in answer to committee's questions that this is not a farm-to-market road in County's mill levy program.

There being no further comments, Chairman Hagness concluded the public hearing, and stated that the comment period remains open for another ten days.

Moved by Beyer and Klave to receive and file the information. Motion carried.

2. Matter of selection of architect for masonry restoration at
water plant, Project No. 4335.
Mr. Lambrecht reported that a memo had been included in their packets re. this matter. He reported that committee had been informed of some of the problem they are having at the plant with cracking, movement, etc. He stated that they direct mailed an ad to all local architects and published ad in the paper; received two proposals: from Schoen Associates, Inc. and from Kent Anderson/Architect, P.C.; that Selection Committee reviewed and recommended that the project be awarded to Kent Anderson.
He also stated that the Anderson firm has done restoration of this type of building (eight buildings at University, and United Lutheran Church)

Moved by Hamerlik and Beyer that the project be awarded to Kent Anderson/Architect, P.C. Motion carried.

3. Matter of certification of tapping fees.
Al Grasser, asst. city engineer, reported that based on recommendation from the city attorney to bring some of these tapping fees back through committee and council for certification based on actual formula that will be used to calculate the tapping fees; and have gone back about the last 7-8 years and tried to pick up and put into same format for certification. He reported there are few left, need to study further before making recommendation on tapping because will impact some developments.
He noted that on Project No. 3807, fees collected will be reimbursed to developer, as City did not front-end the monies on that project. He reported that the City has put out lot of money on tapping fees for economic development in (and expansion of) the city, and will bring in to committee when that information put together.

Moved by Klave and Hamerlik to approve calculations of the tapping fees for projects as attached. Motion carried.

4. Consideration of bids:
a) fuel tank and pump at landfill.
Dick Newman reported that bid tab had been included int he packet: Valley Electric & Petroleum Equipment, $8,755.00 and Hobbs, Inc. $10,035.00. He reported that he had received letter from Hobbs, Inc. informing City that they were protesting the bid results on the project, that they did not believe that Valley Electric & Petroleum Equipment has included the type and quality of equipment that their proposal included; that specifications as written are ambiguous with regard to equipment, quality and type, and requesting that the City rebid the project after upgrading the specifications. Mr. Newman stated that City bid what they wanted, that they didn't receive any protest to the specifications prior to the bid, that protest came in after bids were received. He recommended the bid of Valley Electric and Petroleum, which met specs.

Because Hobbs had not been notified of meeting this evening, the committee held the matter to Tuesday, January 16 at 7:15 p.m. It was also noted that this is a committee only item and does not required council approval.

5. Matter of blowing snow into street when cleaning driveway,
sidewalk, etc.
Clois Hetletved, 807 S. 23rd Street, presented matter of
concern re. snow removal - finding in his street that residents blowing snow back into the street - that after street cleaning crews come through, neighbor having driveway/yard cleared of snow and snow removal contractor blowing/dumping snow into street. He MINUTES/PUBLIC SERVICE COMMITTEE

stated he reported to police, told it was against city ordinance, but that he would have to sign complaint to have enforced (police wouldn't cite unless witnessed violation). Mr. Hetletved stated
he didn't want to do that to his neighbors, and asked if there
was another way to handle.

Charles Grotte, asst. director of public works, read ordinance section 16-0317 Deposition of snow or ice on city streets or sidewalks prohibited. He also read penalty clause, section 16-0307 Penalty.

The committee suggested that residents be given copy of ordinance regulations, as they probably are not aware of prohibition. The also suggested placing notice on water bills to get information to the public.

The committee referred this to Chuck Grotte, to get information to public prior to next storm - when snow and/or storm warnings issued; and to check placing information on back of water bills. The committee also suggested that if they receive complaints, have street department follow up with property owner, provide information to snow removal contractors, or possibly have press release.
