MINUTES/PUBLIC SERVICE COMMITTEE
Monday, May 20, 1996 - 7:00 p.m.

Members present: Hagness, Beyer, Klave, Hamerlik.

1. Matter of creating special assessment districts:
a) Proj. 4476, Dist. 373, sanitary sewer on S. 38th Street
(24th-29th Aves.S.)
b) Proj. 4477, Dist. 248, watermain on S. 38th Street (24th-
29th Aves.S.)
c) Proj. 4478, Dist. 374, storm sewer on S. 38th Street (24th-29th Aves.S.)
Mr. Vein expressed concern re. action committee took re. matter where developer has asked for and is following ordinance re. up-front monies and another developer has ability to petition out the request; in this case gives Greenberg veto power over request from Dan Mikkelson. It was noted that Mr. Mikkelson will pay his 50% up-front monies; Greenberg wants to develop privately. Mr. Mikkelson feels that improvements they have done in the area has provided enough infrastructure not to have to pay the up-front monies.

After further discussion it was moved by Beyer and Hamerlik to hold for 2 weeks. Motion carried.

2. Reconsider resolution of necessity and protests to Paving
Dist. 533, Proj. 4312, determine insufficiency of protest;
receive tabulation of bids, ests. of total cost and award
contract.
The committee discussed the matter and was provided correspondence dated May 13, 1996 from Jim Lynch indicating they are withdrawing their protest on behalf of Rydell's for a portion of their property, which is west of the storage facility; that they will support project and award of the bid. Mr. Eggebraaten's protest will remain in place.
