MINUTES/PUBLIC SERVICE COMMITTEE

Members present: Hagness, Beyer.

1. Matter of electrical equipment bids for Lift Station #29.
Keith Johnson reported this equipment is at lift station where control starters burned up. He stated they requested quotes from Border States and ICS, and received quote from Border States in the amount of $20,298. Tom Hanson, WFW, reviewed project; and stated he didn't like to see sole source bids but in this case felt it was justified as need to get ordered and on site before the flood. It was noted this is budgeted in the project.

Moved by Beyer and Hagness that we accept the bid of Border States Electric Supply in the amount of $20,298. Motion carried.
2. Information.
Howard Swanson, city attorney, reported on the issue of indemnity and liability re. South Washington Street project contracts, that he submitted letter to the NDIRF as to whether they will approve and write coverage for that project. He stated that given the concern over storm sewer portion of the project, any claims will impact loss ratio and have negative effect on the premium, etc. He also stated he will contact State to see if they would amend and exclude liability for storm water from the contract.

Ken Vein reported he wrote to State asked for authorization to redesign storm water drainage to our specs and we would take responsibility and relieve them of liability and then they should have no problem signing off. It was noted bids are being opened on the 21st of February and City will have to concur in award of the contract. Mr. Swanson stated he hasn't signed agreement yet, trying to work through.
