MINUTES/PUBLIC SAFETY COMMITTEE
Tuesday, May 12, 1998 - 7:00 p.m.

Members present: Sande, Beyer, Glassheim.

1. Request to hold block party on 23rd Avenue S., 1900 block
(cul-de-sac), and blocking at South 20th Street, May 15, from
6:30 to 11:00 p.m.
Capt. MacCarthy stated they had no problem with this. Moved by Glassheim and Beyer to approve the request. Motion carried. (comm. only)

2. Request from Shriners, Kem Shrine, for permit to hold Spring
Ceremonial parade on June 6.
Capt. MacCarthy reported that Capt. Kjelstrom had been dealing with this matter, that latest version of the route is from 13th Ave.S. on Washington northbound in the southbound lane, turning west of 7th Avenue to 14th, up 14th to service road by Big Daddy's and west along service road to First National Bank, and that because of the route and S. Washington Street construction, he estimated it would take a number of police officers (12 plus police reserve), starting 10:30 a.m. for approx. 2 hours and that this is a Saturday. Committee questioned use of Washington Street and shutting off southbound lane, and that they had a problem with this. Deputy Chief O'Neill stated this would have impact on fire department also. The committee held the matter for 2 weeks.

3. Request from Price King Rent-a-Car, 301 Gateway Drive re.
parking problem.
Reps. from Price King were not present, and committee reviewed recommendation from John Thompson, traffic engineer, who reported that Price King Auto had requested that they be allowed to pave berm along N. 4th Street side of their property, that paving of an existing berm is undesirable as it would set an unwanted precedent and paving required green space is inconsistent with Land Development Code, and recommended to receive and file. It was noted that they wanted to buy berm from City but not able to do so.
There was some discussion re. Simonson's paved area, and it was noted that they did that without City authorization. (It was noted that they have outgrown their lot {Same thing applies to Shea's Nursery}). Held for 2 weeks.

4. Matter of repairing sanitary sewer at police building.
Mike Shea presented request, that sanitary sewer is tied into storm sewer and need to get fixed as soon as possible and asked for direction from committee. He stated he can get estimate, that there is sanitary sewer in the street, and that he talked to Mr. Schmisek re. funding - est. cost $15-20,000. He stated he would like to get the work done as soon as possible and not wait and bring estimates back to committee; he stated if he had to bid this would have to have specs. and probably pay more than to hire contractor and have him do the work. Mr. Thompson suggested they work in with another project in progress, as change order. Mr. Shea stated that they have Gibb Const. doing sewer repairs and

thinking of putting him on this project when he completes the other projects, give Mr. Schmisek cost and proceed with project. Beyer stated this has to be brought to council. Mr. Shea stated that if this were private property would require fixing it immediately, and wanted to hold ourselves to same standards. He stated he will see what he can do.

Joe Kalenze stated that lot of roof area drains into sanitary system as well, but Mr. Shea stated that could be worked out later need to get sanitary out of storm sewer and if roof drains are connected not as big an impact as continually having sanitary sewer going in, that can be done and budgeted for in 1999.

Moved by Glassheim and Beyer to direct staff to proceed with project at deliberate speed (through change order, etc.) Capt. MacCarthy stated he wanted committee to know that they don't have funds in the budget for this. Motion carried.

5. Matter of overhangs on doors on police building.
Capt. MacCarthy reported that the overhangs on doors on 5th Street and Walnut have deteriorated and have roofing contractor come in and look at and would like repaired out of Public Buildings Fund, est. cost $4200 for both doors and reviewed specs. Committee stated this perhaps should come out of Police Department Bldg. Maintenance and Operations and this should be run by Mr. Schmisek. Capt. MacCarthy stated they don't have any money in the 1998 budget, but is getting to be safety problem. Beyer moved to proceed with project (repair of overhangs in the amount of $4200 from Public Buildings Fund. Motion died for lack of a second.

Moved by Glassheim and Beyer to hold and discuss with city auditor.

6. Request from VFW Post 1874 for sale of Buddy Poppies between
May 18-24.
The request was reviewed by the committee. Moved by Beyer and Glassheim to approve the request. Motion carried. (comm.only)

7. Applications for gaming permits:
a) Site Authorizations (7/01/98 - 6/30/99)
1) Fargo Moorhead Community Theatre - 1970 S. Columbia Rd.
(Borrowed Bucks Roadhouse)
2) North Dakota Assn. for the Disabled - (Ramada Inn, Hwy.
2 West, and Bingo Palace at South Forks Plaza)
It was noted that the applications had been reviewed and approved by the city attorney. Moved by Glassheim and Beyer to approve the application. Motion carried. (comm.only)
b) Greater Grand Forks Jaycees - raffle 07/15/98.
It was reported that the application had been reviewed and approved by the city attorney. Moved by Glassheim and Beyer to approve the application. Motion carried. (comm.only)

8. Applications for gaming permits:

It was noted that applications had been reviewed and approved by the city attorney. Moved by Glassheim and Beyer to approve the applications. Motion carried. (comm.only)

9. Request from American Legion Auxiliary Poppy Day to distribute
poppies on Saturday, May 23, 1998.
A request from American Legion to sell poppies was reviewed by the committee. Moved by Beyer and Glassheim to approve the request, pending signing of a hold harmless agreement. Motion carried. (comm.only)

3. Reps. of Price King Auto were present, and stated that there are numerous buildings on Gateway Drive that don't have any green space, they still have shrubbery, two corners that face Gateway Drive for green space, and are only asking for 4th Street side and not set any precedent (Simonson's, Bob's Cycle have no green space, etc.) Committee stated that they have outgrown their lot, but Reps stated that flood set them back $250,000 and don't have more money to go build anyplace else in the city at this time, but need to keep paying off their debt, best thing for them is to stay in business; and asked if there was anything they can do on sidewalk, that nobody uses it and anything would help them - if could get 6 months (shuffle some cars to Fargo - have lot there) so not get tickets. Committee stated they didn't know if they could allow someone to intrude into sidewalk area - they wouldn't park there but bumpers hang over into sidewalk area. After further discussion it was moved by Beyer and Glassheim to ask traffic engineer whether City could assign 6- month closure of sidewalk contingent upon Price King signing a hold harmless agreement and agreeing to repair berm and sidewalk areas if damaged. Motion carried.

10. Matter of Fair activities July 10-19.
Bob Amundson, Greater GF Fair Assn., reported that the Fair Week has been expanded to 10 days, that when carnival no longer played Fargo (State Fair unit) saw opportunity to move our Fair dates from June to July hoping to attract that carnival, and have done so (35 rides, lot more revenue for the Fair and city), that one of the things they project to do is open commercial building for 3 days for exhibits, etc., and would like transfer of beer license as they would like to use the commercial building for six days and turn into a dance hall with pop and beer (food outside), and have activities each evening Tues./Saturday. He stated that they would need to transfer beer license to that building, whether temporary permit, etc.; Fair is July 14-19. Capt. MacCarthy stated that their original license would give beer license at grandstand and file temporary request. Mr. Amundson stated they would be

doing on their own property and their people operating. Moved by Beyer and Glassheim to approve request from Fair Board to have their beer garden July 14 - 19 contingent upon all paperwork being satisfactory to police department and city attorney. Motion carried.

11. Miscellaneous items:
Glassheim asked for report from John Thompson, traffic eng., on Columbia Road and 28th Street at next meeting; and report on down-town area. Sande reported that in the Transportation Plan there is a diagram of all the parking in the downtown but doesn't show signage (does show handicapped, parking but not signs). Beyer stated they could bring up at DDC's meeting on Thursday, and then following at this committee.

12. Miscellaneous - dead dog issue.
Beyer stated that Dennis Borowicz, Urban Development, removed dogs and is convinced that dogs were thrown in dead. Glassheim asked whose jurisdiction it is/who is responsible. Capt. MacCarthy reported that normally they would be responsible but were advised by the health department not to remove. Don Shields, Health De-partment, stated that number of dogs in a pool and Mr. Speaker contacted Urban Development (City is property owner). He stated they recommended removal of animals and pump pool as septic water (water needs to be pumped out by person certified to pump out septic systems). (It was noted that dead animals put in bag and taken to landfill) Dep. Chief O'Neill stated they get calls re hazardous materials, and are trying to find out those answers and trying to find resource list to call for hazardous materials.), and dead animal in water after number of days is hazardous material. Glassheim stated that the question came up because it took a week to happen after call came in, and that he doesn't find that accept-able and interested in what to do to take care of it. After further discussion it was stated that property owner is responsible and that Urban Development would be responsible and because of safety issue to take care of it in a timely fashion. Mr. Shields stated there was a breakdown on getting animals out in a timely manner. Sande stated that the local vets have to deal with dead animals and they must know how to dispose of animals and it was noted that the landfill takes them. Mr.Shields stated their department was responsible for providing advise and assistance and recommendations on how to do it. Beyer stated making recommenda-tion that departments work out solution to this and bring back to committee; it was noted that this doesn't happen every day. Mr. Shields stated they can work this out with other departments. Deputy Chief O'Neill commented re. liability re. hazard materials. Sande stated that if dead animal on somebody's property, owner is responsible, but this was City owned property. Information only.
