OF THE CITY OF GRAND FORKS, NORTH DAKOTA

The city council of the city of Grand Forks, North Dakota met in special session in the council chambers in the City Hall on Thursday, November 30, 1995 at the hour of 7:00 o'clock p.m. with President Hagness presiding, pursuant to call by Mayor Polovitz, which was served on all members on November 29, 1995: Document No. 6644 - Notice.

Present at roll call were Council Members Beach, Hoeppner, Glassheim, Carpenter, Klave, Babinchak, Johnson, Hagness - 8; absent: Council Members McCabe, Hamerlik, Hanson, Sande, Beyer, Geller - 6.

CANVASS RETURNS OF SPECIAL CITY ELECTION
HELD NOVEMBER 28, 1995

The deputy city auditor reported that returns from the 26 precincts of the city on the results of the special city election which had been held on Tuesday, November 30, 1995 had been received by the auditor's office. It was reported by Mr. Swanson, city attorney, that there were discrepancies in polling books in four precincts, that the total votes did not balance with the total Yes or No votes, that staff has recounted and has now balanced in those precincts. Mr. Swanson stated that it was the responsibility of the council to review the work of staff to insure that the vote is in balance, and with respect to the other wards and precincts, to either review actual ballots, or to review the summary sheets that have been prepared, with ultimate action to certify the election results and note in the minutes.

President Hagness appointed the members of the city council as the canvassing board to canvass the results of the election with instructions to review the summary sheets of the election results as submitted by the auditor's office.

The deputy city auditor reported that there were a total of nine absentee ballots which had been received by their office, that 6 are not timely because either not signed or not postmarked prior to the election, and 3 are proper to be opened. President Hagness instructed Council Members Johnson, Babinchak and Klave to open one of the absentee ballots; Council Members Beach and Hoeppner to open one; and Council Members Glassheim and Carpenter to open one. The absentee ballots were distributed, opened and counted as follows: Ward 6, Precinct 2: Yes vote; Ward 6, Precinct 2: No vote; and Ward 7, Precinct 1, Yes vote.

COUNCIL MEMBER CARPENTER EXCUSED

The council members proceeded to canvass the votes cast in the special city election held on November 30, 1995 and submitted the following report: Document No. 6645 - Report.

It was moved by Council Member Beach and seconded by Council Member Hoeppner that we certify results as final and enter poll count into the official minutes, including finding that 6 absentee ballots were not timely and not counted. Carried 7 votes affirmative.

ADJOURN

It was moved by Council Member Johnson and seconded by Council Member Klave that we do now adjourn. Carried 7 votes affirmative.
