1. Purpose

  1. The purpose of this article is to promote historic districts and landmarks for the educational, cultural, economic, and general welfare of the public through the preservation, protection and regulation of buildings, sites, monuments, structures, and areas of historic interest or importance within the City of Grand Forks; to safeguard the heritage of the city by preserving and regulating historic landmarks and districts which reflect elements of its cultural, social, economic, political, and architectural history; to preserve the city's economic base by the stimulation of the tourist industry; to establish and improve property values; to foster economic development; to manage growth; to foster civic pride in the beauty and noble accomplishments of the past; and to promote the use of historic districts, landmarks, interior landmarks, and scenic landmarks for the education, pleasure and welfare of the people of the City of Grand Forks.

  2. It is intended that the commission will cooperate with and assist various local, state and federal entities and/or agencies in the enforcement of federal and state legislation to identify, evaluate, designate, and protect properties significant in the prehistory, history, architecture, engineering and culture of the community, state and nation.

  3. It is further declared that the purposes of this article are:

With respect to the properties in historic districts:

  • To retain and enhance those properties which contribute to the character of the historic district and to encourage their adaptation for current use;
  • To assure that alterations of existing structures are compatible with the character of the historic district; and
  • To assure that new construction and subdivision of lots in an historic district are compatible with the character of the historic district.

With respect to historic landmarks:

 

 

2. Members, Appointments & Terms

  • The commission shall consist of eleven (11) members.

  • The commission members shall be appointed by the mayor with the advice and consent of the city council.

  • Each of the members of the commission shall be appointed for a term of two (2) years.

  • The members shall serve without compensation but shall be reimbursed for expenses necessarily incurred in the performance of their duties.

3. Member Qualifications

Members appointed by the mayor shall be persons who, in the opinion of the mayor, have demonstrated outstanding interest and knowledge in historical or architectural development. A majority of the commission members shall be made up of persons from among professionals in the disciplines of architecture, history, architectural history, planning, archeology or other historic preservation related disciplines, such as urban planning, American studies, American civilization, cultural geography or cultural anthropology, to the extent that such professionals are available in the community.

4. Powers and Duties

  1. Adopt criteria for the identification of essential structures, priority structures and preservation of areas.

  2. Prepare or cause to be prepared a comprehensive inventory of essential structures, priority structures, and preservation areas within the city.

  3. Make recommendations to the city council concerning the acquisition of development rights, facade easements, and the imposition of other restrictions in the negotiation of historical property contracts for the purpose of historic preservations.

  4. Increase public awareness of the value of historic, architectural and cultural preservation by developing and participating in public information programs and by recommending the update of the preservation programs.

  5. Make recommendations to the city council concerning the utilization of grants from federal, state and local agencies or entities, private groups, individuals, and the utilization of budgetary appropriations to promote the preservation of historic or architecturally significant structures in the city.

  6. Promulgate standards for architectural review.

  7. Evaluate and comment upon decisions by other public agencies affecting the physical development and land use patterns in the city.

  8. Recommend to the city council that the city purchase an essential structure where private preservation is not feasible.

  9. Prepare nominations for properties deemed by the commission to be significant in local, state and/or national history.

  10. Upon request by the state historical society, or upon action of the commission, prepare and submit to the mayor a report stating the commission's opinion concerning compliance with criteria for listing premises or structures in the National Register of Historic Places.

  11. Submit and file such information, findings and resolutions deemed necessary and appropriate by the commission with the state historical society.

  12. Review and comment to all local, state or federal agencies and/or entities deemed necessary with regard to governmentally funded, assisted or licensed projects with emphasis as to the presence of significant properties within the project's impact area, the extent of the project effect on significant properties and proposed means of mitigating any adverse effect.

  13. Review and comment to all local, state and federal agencies and/or entities deemed necessary on certifications of significance and certifications of rehabilitation.

  14. Any other functions which may be designated by resolution or motion of the city council.
