Federal Law


Section 7(r) of the Fair Labor Standards Act requires employers to provide reasonable break time for an employee to express breast milk for her nursing child for one year after the child’s birth each time such employee has a need to express the milk. Employers are also required to provide a place, other than a bathroom, that is shielded from view and free of intrusion from coworkers and the public, which may be used by an employee to express breast milk.

North Dakota State Law

A woman has the right to breastfeed her child in any location, public or private, where the woman and child are otherwise authorized to be. North Dakota legislation also established an “infant-friendly” designation for workplaces that adopt a breastfeeding support policy.
